' e OMB SUPPORTlflG STATEMENT FOR flRC FORM 790 Classification Record Description of Information Collection This reporting requirement affects approximately 28 NRC licensees and contractors that are permitted to use, process, store, reproduce, transmit, or The NRC Form 790 is completed otherwise handle NRC classified information.

The information contained on the completed form includes specific information which identifies the document being classified or declassified as well as specific information describing the action being taken (e.g., original or derivative classification, reason for the declassification review, future action). This information, enables NRC to conduct assessments of classification or declassification determinations made by those officials specifically authorized to make such determinations.

A. JUSTIFICATION

1. Need for the Collection of Information.

Executive Order (E.0.) 12356, " National Security Information,"

empowers the Director, Information Security Oversight Office (IS00)

" ...to require of each agency those reports, information, and other cooperation that may be necessary to fulfill the Director's responsibilities..." to oversee NRC's actions to ensure compliance with E.0. 12356 and implementing directives. This requires the NRC to report classification / declassification of all documents to IS00.

NRC form 790 is the means by which the NRC Division of Security (SEC) collects this data from its own employees, licensees, contractors, and other organizations and persons falling within the scope of 10 CFR Part 95 or NRC Manual Chapter 2101, Appendix Part III. Failure to complete this form would preclude NRC from meeting its expected classification / declassification reporting responsi-bilities prescribed by 1500 and from evaluating classification /

declassification actions during appraisals, inspections and audits.

2. Agency Use of Information.

l The completed NRC form 790 is submitted to SEC. The data provided on the form is entered into a computer. The data is then tabulated, stcred and as needed, a report is produced. This report is used by SEC to keep track of classification and declassification decisions arrived at by authorized officials. Various statistical data generated by this report are provided to 1500 pursuant to their responsibilities under E.O. 12356. The data is also used by NRC during inspections, appraisals, or audits of the affected facilities or persons.

3. Reduction of Burden Through Information Technology.

No reduction in the information collection burden can be realized through information technology with respect to the NRC Form 790.

The information contained /obtained on the form is classification or declassification specific. .

4. Effort to Identify Duplication.

The information collection requirement does not duplicate information the affected licensee, organization, or person must submit for other ps.rposes since the nature of the information being a requested / collected is unique to NRC's activity at the facility.

5. Effort to Use Similar Information.

No similar information exists.

6. Effort to Reduce Small Business Burden.

None of the licensees, organizations, or persons affected qualify as small businesses.

7. Consequences of Less Frequent Collection.

The NRC Form 790 is completed as a classification / declassification action occurs. If not completed when the events occur, NRC will not have the information necessary to evaluate the information security program at the facility, which would negatively impact on NRC's responsibility to ensure the proper protection of classified information and compliance with Executive Order requirements.

8. Circumstances Which Justify Variation from OMC Guidelines.

1here is no variation from OMB Guidelines in this collection of information.

9. Consultations Outside the NRC.

No consultations have been held since the submittal of the last clearance package. .g

10. Confidentiality of the Information.

The information is used to ensure proper classification, declassification, and accountability of classified information. The '

information compiled on the NRC Form 790 is not, itself, classified or sensitive unclassified information. There is no confidentiality of the information, nor is confidentiality of the information expressed or implied. _

11. Justification for Sensitive Questions.

No sensitive information is requested on the NRC Form 790.

12. Estimated Annualized fost to the Federal Government.

The estimated annualized cost to the Federal Government in

-administering the program and procedures contained in 10 CFR Part 95 or NRC Manual Chapter 2101, Appendix Part III produces 293 responses per year. The time required to process each form is 5 minutes, therefore, the total number of hours required to process NRC Form 790 is 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> per year. The estimated annual cost to the Government is $1,440 (24 hrs /yr X $60).

13. Estimate of Burden.

The NRC Form 790 imposes an estimated annual burden of 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> (293 responses X 5 minutes). The annual cost of this burden is estimated to be $1,440 (24 hrs /yr X $60).

14. Reasons for Changes in Burden.

The number of forms submitted to NRC has increased under the Classified Safeguards Program, 10 CFR Part 95.

15. Publications for Statistical Use.

NRC tabulates and arranges the information contained on the form, and provides it to IS00, as needed.

Please note that NRC Form 790 must be completed by the Authorized Classifier for each classification or declassification review which results in an original or derivative classification, declassification, or classification level upgrade or &wngrade. The Authorized Classifier must submit two copies of the completed and signed form to the Information Security Branch, Division of Security, on the day the classification or declassification review is completed.
