In a Staff Requirements Memorandum dated June 12,1998, (srse All Agreement States letter SP-98-057, dated July 2,1998), the Commission directed NRC staff to request documentation on conflict of interest and ethics regulations or procedures from prospective Agreement States.

We note that information on your expectations for performance by the technical staff members is included in Attachment 2 of Exhibit 6 in Volume 2 of your draft request for an Agreement. In order to satisfy the Commission's requirements, we request that you submit, in addition, copies of the laws, Statewide regulations, and/or Departmental policies and procedures on conflict of interest and ethics applicable to the radiation control program staff that will perform duties in areas covered by the Agreement. The documentation should be included in the formal request

. when submitted by Governor Voinovich.

AFF REQUIREMENTS - SECY-98-068 - CONSIDERATION OF APPLICATION OF FEDERAL GOVERNMENT-WIDE CONFLICT OF INTEREST OR ETHICS REQUIREMENTS AND l NRC ENFORCEMENT POLICY ON LICENSEE INTEGRITY ISSUES TO AGREEMENT STATE PROGRAMS The Commission has approved the staffs recommended approach to the issues raised in the subject paper. The staff should move to implement the NRC's deliberate misconduct rule as a matter of compatibility category C, whether by rule or otherlegally binding requirements which meet the objectives of the deliberate misconduct rule. With respect to the need for determining the compatibility category of employee protection rules, the staff should survey and discuss the l issue with the Agreement States and appropriate organizations and provide an opportunity for

public comment on this issue. 9700226 i

Prospective Agreement States thould be requestod to submit documentation of State conniet of g interest and ethics regulations or procedures applicable to those portions of the State radiation control program covered by the Agreement.

The staff should coordinate with the Agreement States to determine whether they can provide the NRC with information on State actions to prohibit individuals - licensed or unlicensed -

from involvement in licensed activities for the purpose of sharing such information. The staff Q.

should consider the feasibility of adding relevant Agreement State information to the a compilation of information on NRC actions et=ntly available on the NRC Home Page.
