REPORT- 95TH MEETING OF THE ADVISORY COMMITTEE ON ,

NUCLEAR WASTE (ACNW), OCTOBER 21-23,1997, AND OTHER RELATED l ACNW ACTIVITIES

Dear Chairman Jackson:

During its 95th meeting on October 21,1997, held at the William F. Bolger Center for Leadership Development,9600 Newbridge Drive, Potomac, Maryland, and on October 22 and 23,1997, held at Two White Flint North, Room T-2 B3,11545 Rockville Pike, Rockville, Maryland, the ACNW reported on and discussed the following key issues:

! Chairman, ACNW," Recommendations Regarding the implementation of the Defense-in-Depth Concept in the Revised 10 CFR Part 60," dated October 31,1997.

HIGHLIGHTS OF KEY ISSUES CONSIDERED BY THE COMMITTEE

1. ACNW Retreat The ACNW he'd I an all-day planning session on October 21,1997, at the William Bolger Center in Potomac, Maryland. Participants included ACNW members and staff, a facilitatory, and a guest speaker, Commissioner Dicus.
The purpose of this session was to review the Committee's plans for the next year and l to continue the work on the Committee's strategic plan.

Commissioner Dieus discussed her views on important reoulatory issues in the waste management area. The Committee discussed past accomplishments and priorities; \C l ideas for an ACNW mission, vision, goals, and priority activities; ACNW operations and process; and quantitative performance measures. .

The Honorable Shirley Ann Jackson 2 Conclusions / Action items The Committee agreed to have a draft strategic plan prepared for discussion at the November 1997 meeting, and to be prepared to discuss the ACNWs priorities with the Commission during the December 1997 Commission meeting.

2. Review of Nuclear Reaulatory Commission Waste-Related Research and Technical Assistance The Committee reviewed background information for use in preparation of its input into i

the annual Advisory Committee Reactor Safeguards report to Congress on the agency's safety research program. The first presentation was made by Giorgio Gnugnoli, who discussed a draft document titled, " Scoping Document on the Effectiveness of NRC's Program in Research and Technical Assistance for Radioactive Waste Management,"

which he had prepared for the ACNW members' review.

Sher Bahadur and William Ott, Office of Nuclear Regulatory Research (RES), discussed 3 the radionuclides transport research program currently underway in RES. They also

) noted how programs had been redesigned to accommodate budget reductions. In response to questions from Dr. George Homberger, session chair, Michael Bell, Office of Nuclear Material Safety and Safeguards (NMSS), reviewed the recent budget history at the Center for Nuclear Waste Regulatory Analyses (CNWRA), and he closed his presentation with an update of the status of research and technical assistance activities being done at the CNWRA and at the NRC headquarters.

3. Preparation for the Next Meetina With the Commission The Committee discussed topics and made staff and member assignments in preparation of discussion topics for the next meeting with the Commission on December 17,1997.

Conclusions / Actions items The subjects to be proposed for discussion during the meeting with the Commission will include the following: (1) the high-level waste (HLW) performance assessment (PA) capability of the NRC staff, (2) def2nse in depth, (3) the application of probabilistic risk assessment methods to PA, and (4) ACNW priority issues.

PROPOSED SCHEDULE FOR THE 96TH ACNW MEETING The Committee agreed to consider the following issues during the 96th ACNW Meeting on '

November 20-22,1997:

Meetina with NRC's Director. Division of Waste Manaaement (DWML NMSS -The Committee will meet with the Director of DWM to discuss developments at the Yucca Mountain project, resources, rules being developed, and other items of mutual interest.

. yygste Classification at West Vallev. Hanford. and Savannah River-The NRC staff will brief the Committee on its evaluation of the Department of Energy's methodology for classification of waste resulting from treatment, bulk HLW removal, and cleaning of tanks. Background and history will also be discussed, along with current status, review schedules, and criteria for the classification of wastes as incidental.

. Standard Review Plan (SRP) for Soent Fuel Drv Storaae Facilities -The Committee will review and provide comments on this SRP.

. Status Reoorts on the Resolution of the HLW lssue and Acceotance Criteria -The NRC staff will update the Committee on the progress of staff reviews related to the HLW key technicalissues (tentative).

. NRC's DWM Priorities - The Committee will review DWM's priorities and planned interactions with the ACNW for the coming year.

. Preparation for the Next Meetina With the Commission - The Committee will prepare for its next formal meeting with the Commission. The Committee is scheduled to discuss items of mutual interest with the Commission on December 17,1997.

. Preparation of ACNW Reoorts -The Committee will discuss planned reports, including comments on the SRP for Spent Fuel Dry Storage Facilities, comments on NRC waste-related research, ACNW priorities, and other topics discussed during the meeting, as needed.

. Committee Activities / Future Aaenda -The Committee will consider topics proposed for future consideration by the full Committee and by Working Groups. The Committee will discuss ACNW-related activities ofindividual members.

OTHER RELATED ACTIVITIES OF THE COMMITTEE The 97th ACNW meeting is scheduled to be held on December 16-18,1997. The Committee agreed on tentative meeting dates for calendar year 1998.
