NOTICE OF VIOLATION Midwest Industrial X-Ray, Inc. North Dakota License No. 33-14907-01 As a result of the inspection conducted on August 10-11, 1989, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1989), the following violations were identified:

1. 10 CFR 150.20(b)(1) requires that when engaging in activities in non-Agreement States urder the general license granted by 10 CFR 150.20(a), .

you must file four copies of Form-241 (revised) " Report of Proposed '

Activities in non-Agreement States" and four copies of your Agreement State specific license with the Regional Administrator of the appropriate Nuclear Regulatory Commission Regional Office within at least three days l prior to engaging in such activity.  !

Contrary to the above, industrial radiography was performed throughout Minnesota on numerous occasions during 1988 and 1989 under the provisions .

of 10 CFR 150.20(a) without submission of Form-241 to any NRC office. '

This is a Severity Level IV violation (Supplement VI).  !

2. 10 CFR 34.42 requires that notwithstanding any provisions in 20.204(c),

areas in which radiography is being performed shall be conspicuously posted as required by 20.203(b) and (c)(1). 20.203(b) requires that '

each radiation area be posted with a sign or signs bearing the radiation caution symbol and the words " Caution - Radiation Area." 20.203(c)(1) requires that each high radiation area be posted with a sign or signs bearing the radiation caution symbol and the words " Caution - High Radiation Area." 1 l

Contrary to the above, on August 10, 1989, " Caution - Radiation Area" and l

" Caution - High Radiation' Area" signs were not posted, in areas where '

radial. ion levels created radiation and high radiation areas, during  ;

radiography operations at a Becker, Minnesota field site.

This is a Severity Level IV violation (Supplement VI).

3. 10 CFR 34.33(a) equires that pocket dosimeters be worn by radiographer and be recharged at the start of each shift.

Contrary to the above, on August 10, 1989, a pocket dosimeter worn during radiographic operations at a Becker, Minnesota field site was not recharged at the start of the radiographer's shift.

This is a Severity Level IV violation (Supplement VI). l

4. 10 CFR 34.24 requires that each survey instrument used to conduct )

physical radiation surveys be calibrated at intervals not to exceed l three months and also after each instrument servicing.

Notice of Violation 2 Contrary to the above, on August 10, 1989, a Victoreen 492 GM survey instrument which had not been calibrated since May 1,1989, was used to conduct physical radiation surveys at a Becker, Minnesota radiography site.

This is a Severity Level IV violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to chis office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) the corrective actions that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shcwn.
