Dear Mr. Raines:

I am writing this letter to follow up on your December 4, 2020, e-mail request (Agencywide Document Access and Management System, Accession No.: ML20352A043) to receive a copy of Regulatory Guide (RG) 5.76, Revision 1, Physical Protection Programs at Nuclear Power Reactors. RG 5.76, Revision 1 has been designated as Safeguards Information (SGI). As such, licensees, certificate holders, applicants and other persons seeking access to RG 5.76, Revision 1 must have an established need-to-know for the requested information and the ability to receive, possess and handle the information in accordance with the U.S. Nuclear Regulatory Commissions (NRCs) regulatory requirements for the protection of SGI.

The NRC typically does not provide SGI to contractors and vendors if they can obtain the requested information from a licensee or other authorized holder of the requested SGI. The NRC understands that ARES Security Corporation supports NRC licensees and other holders of SGI and has a licensee-approved SGI program. Accordingly, the NRC recommends that you contact the licensee that has approved your SGI program and request that they provide you with a copy of RG 5.76, Revision 1. If that effort proves unsuccessful, then please contact the NRC and we will determine an appropriate path forward.
