In response to a March 27,1997, Staff Requirements Memorandum on Strategic Assessment Direction Setting issue: Fees (DSI 21), this paper addresses the issue of Iggc.w whether to seek ac#vities from OMD the fee andfund base and Congressional authorization these activities through to remove the costs separate appropriations from general funds. The need to perform these activities is not addressed in this paper because it was addressed in the FY 1999 budget proposal.

The legislation recommended in the February 1994 Report to Congress on the U. S. Nuclear Regulatory Commission's License Fee Policy Review to remove the costs for certain activit:ss that raised fairness and equity concerns from the fee base h was not enacted. Although these issues remain, changes have occurred in the marketplace since that time affecting NRC licensees, such as the electric utility economic deregulation.

While not addressed in the Report to Congress, recovery of costs for the Site Decommissioning Management Program and generic decommissioning and 3.g gp reclamation activities were addressed in SECY-95-017 (Reinventing NRC Fee Policies)

,, TL dated January 25,1995. The FY 1995 final fee rule implemented the Commission

-- decision in the SRM dated February 10,1995, to allocate these costs to a!! licensees that pay annual fees based on the amount of the budget directly attributable to a class of licensees.
