Commissioner McGaffigan's Comments on SECY-99-219 I approve the publication of the revised Enforcement Policy and commend the staff for their efforts in developing and implementing the changes this revision contains. I concur in the comments and edits of Chairman Dicus and attach a couple other minor edits.

The NRC recognizes that additional changes may be considered as a result of ongoing
. efforts to make improvements to the inspection and performance assessment processes for power mactors. In addition, changes are anticipated in the materials areas that will conform to the move k ~ toward risk-informed performanc6% sed inWons in this area.
The more significant changes to the Enfortement Policy (in the order that they appear in the policy) are described below: '

This section has been modified by adding a discussion of the relationship between safety l and compliance. This discussion captures the essence of the Comminion-approved discussion that was previously included as Appendix A to this policy statement. Moving this discussion from the back of the policy to the front improves the logical flow ofinformation and helps ensure l- that it will not be overlooked.-
