Dear Ms. Garde:
This letter responds to your October 20, 1985 appeal of this Agency's denial of dacuments identified in our October 1,1986 response to F01A-86-53, 86-54, and 86-55.
In response to your appeal, the withheld material was re-reviewed. On the basis of this review, a portion of document N21 is being released and will be placed in the NRC Public Document Room (PDR) located at 1717 H Street, N.W., Washington, D.C. 20555, in file folder F0IA 86-53 in your name. With respect to the balance of denied documents and portions of documents, I affirm the Agency's decision in this matter.
The documents or portions of documents withheld pursuant to Exemption 5 of the F0IA consist of drafts, predecisional analyses, comments and recommendations. Release of this information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.
See, NLRB v. Sears Roebuck and Co., 421 U.S. 132, 151 (1975). Further, the withheld documents or portions of documents contain no reasonably segregable factual information.
