Dear Mr. Knotts:

This letter is a written statement of the acireement which has been made between the United States Atomic Enc. 'o=nission and the State of Minnesota, as follows:

1. It is acknowledged that on Novenfoer 23, 1971 the AEC filed its Determination not to suspend operation of the Monticello nuclear generating plant authori7ed pursuant to DPR-22 pending completion of NEPA review. On December 2 3, 1971, MECCA (Minnesota Environmental Control Citizens' Association) filed a request for hearing on the Determination. The State of Minnesota has requested an extension of time for filing a request for hearing until on or before February 23, 1972, and the AEC staff has indicated that it has no objection to such request.

2 Pending the filing of its request for hearing, the State of Minnesota (Pollution Contro) Agency) requested the AEC to advance the scheduled issuance of its draft environmental impact statement on Monticello to th e'arliest practicable date. The AEC has agreed to place priority upon the preparation and issuance of the draft impact statement on Monticello.

It is acknowledged and agreed that the preparation of the ,

draft impact statement has been undertaken, and the AEC agrees to exert its best efforts to prepare and issue the statement on or before May 1, 1972. The date of May 1, 1972 represents inn advancement of approximately three months over the previously scheduled issuance date.

the impact statement, the State of Minnesota will defer filing a request for hearing on the suspension determination. It is ,

agreed that there will be an opportunity for a consolidated hearing which would commence as soon after May 1, 1972 as practicable, and no later than June 1, 1972, unless otheraise agreed. It is understood that the consolidated hearir.g would encompass both the draft impact statement and Forthern States Power Company's application for a permanent operating license, and any other matters appropriate for hearing. It is agreed that a consolidated hearing as above described will make it possible to define the issues for hearing with greater precision than otherwise would be the case. It is agreed by i the AEC that there will be no objection to the standing of

- the State of Minnesota or MECCA to participate in the consolidated hearing.

4. If for any reason it appears to the AEC that the draft impact statement will not be issued by May 1, 1972, as scheduled, it  !

is understood that the AEC will promptly notify the State of l Minnesob of any such delay and of the extent thereof. It is understood that if the issuance of the draft impact statement is delayed beyond May 1, 1972, for any reason, the State of Minnesota's right to request a hearing on the suspension determination will be reinstated and reserved.  ;.

5. Nothing in this agreement shall be construed tr constitute a limitation, waiver or relinquishment of any position, right or remedy of either party, except as specifielly recited herein.

Please indicate your acceptance of the foregoing on behalf of the U.S. Atomic Energy Commission by signing copy of this letter at the place indicated below.
