In late September 1997, the U.S. Nuclear Regulatory Commission withdrew the Draft Environmental Impact Statement (DElS) concerning the Babcock & Wilcox (B&W) Shallow Land Disposal Area (SLDA) in Parks Township, Pennsylvania, because additional analysis was needed. As reported to you by phone call, we indicated there were three reasons. First, the modified stabilization in place (MSIP) attemative identified by the NRC staff was not presented in the same format and level of detail as the other alternatives. Second, identification of this preferred alternative was inconsistent with NRC policy, in that the afternative was not evaluated to determine if it was clearly environmentally superior, not merely economically superior. Third, the staff needed to consider the application of the new license termination criteria rule, which was published in the July 21,1997, Federal actglater, to the B&W SLDA site We also informed you that when the staff identified more detailed procedures for pursuing decommissioning of the site, we would advise B&W and interested parties. This letter provides those more detailed procedures.
At this time, we have concluded that it would be inappropriate to conduct further analysis on the DEls until a formal request for a licensing action is before NRC. In tha absence of a licensee proposal filed in accordance with the Commission's regulations (e.g., license amendment request), there is no federal action before NRC. Thus, the NRC staff will refrain from publishing any revised DEIS until B&W has submitted a formal license amendment request. You should follow the provisions of the recently promulgated license termination criteria rule which allows licensees to follow one of several different approaches to decommissioning (see e.g.,10 CFR $$ 20.1401(b),20.1402,20.1403, and 20.1404). Note that 920.1403 requires licensees to document how the advice of individuals and institutions in the commun;ty has been sought and incorporated. Once B&W submits a license amendme74 request to authorize decommissioning and states its proposed option for decommissionirig of the SLDA site, we can discuss the schedule for decommissioning submi9als and hRC reviews.
