On _ March 2,1981, the Embassy of Israel requested a license to authorize the export of an uranium isotopic sample to the Israeli Atomic Energy Commission.
That application (number XSNM01800) was referred by the NRC to the Executive Branch, according to our established procedures, for review and comment as to whether the issuance of the license would meet the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1,978.
As lead Agency for the Executive Branch, the Department of State has informed the NRCsthat the necessary determinations under the Atomic Energy Act, as amended, cannot be made for a recommendation of approval, and has recommended that the license request be denied.
Under NRC Rules and Regulations (10 CFR 110.44(d)) the Commission will deny any A. export license application for which the Executive Branch judgment does not recommend approval. Accordingly, your application of March 2, 1981 is denied.
