Computer Access and Operating Agreement l l

l This Agreement is made between the NUCLEAR REGULATORY COMMISSION ("NRC") and i WOLF CREEK NUCLEAR OPERATING CORPORATION ("WCNOC"), agent for its owner companies, Kansas Gas and Electric Company, Kansas City Power & Light Company

)

and Kansas Electric Power Cooperative, Inc. (collectively referred to as l

" Owners") for the purpose of - providing the NRC with access to certain of WCNOC's computer data bases.

WHEREAS, WCNOC desires to enhance the NRC's ability to perform its regulatory l functions with respect to the Wolf Creek Generating Station ("WCGS") by providing the NRC with access to certain computer hardware, software, and data l bases owned by the Owners and under WCNOC's control so that data needed for NRC inspection activities may be electronically accessed in a timely manner; and WHEREAS, WCNOC is willing to make available to NRC certain computer hardware, software, and data bases as appropriate or otherwise necessary for NRC to continue to perform its regulatory responsibilities subject to the terms stated below; 1 l

1. At no charge, WCNOC will only make available and maintain for NRC's office at WCGS a personal computer and associated hardware and the following software and data bases necessary for the NRC to access WCNOC information that the NRC requires to fulfill its regulatory responsibilities:
a. Basic office automation tools on the WCNOC network including, but from time to time not limited to: MS Exchange; Word for Windows; Excel; scheduling software i (i.e., Project-View, or its successor software, as l applicable); MPAC (and its successor software, as l applicable); Curator; i
b. WCNOC General Inquiry Menu of data bases on Mapper, or a replacement carrying such information; and
c. Paperless Environment
2. The software and data bases referred to above will be available to NRC through " view only" access with no data modification capability and no control over the associated sof: ware programs.

However, NRC will have the capability to print out and/or to save i to computer disk such data as may be retrievable from the above data bases.

3. WCNOC acknowledges that all communications that are part of the l formal licensing process will continue to be accomplished in a l format consistent with the relevant NRC regulations contained in Title 10 of the Code of Federal Regulations, i.e., in a paper format or by electronic exchange and processed according to NRC's normal docketing procedures.
4. NRC acknowledges that all data and any hard printouts of such data made available to NRC pursuant to this Agreement are " owned" and under the " control" of WCNOC and NRC will treat such information as proprietary to that company unless determined otherwise.

However, any data which the NRC reduces to hard copy printout, or transfers to a computer hard-drive or disk, in an NRC Resident Inspector's of fice, is considered an agency record under Federal 9903120046 990303

WCNOC information residing on NRC hard-drives or in NRC's possession, in.hard copy or electronic form, prior to any public release, NRC will provide WCNOC the opportunity to request that the information be withheld from public disclosure based upon its proprietary nature by executing an affidavit in accordance with agency regulations, 10 CFR 6 2.790.

5. The' term of this Agreement shall be for one year from itu date of execution. by ' both parties. Thereafter, this Agreement shall be extended automatically on a year-to-year basis until terminated by

-either party giving ten days prior written notice of termination to the other party.
