COMMENTS ON THREE WASTE MANAGEMENT BILLS e

This is to request your comments on three bills regarding radio-active waste management.

,J.136Q.would direct the Secretary of Energy to enter into a formal concurrence arrangement with the Governor of any State (

proposed as a site for a radioactive waste repository. Among other things, any arrangement would authorize a State veto over '

facility construction or operation. The NRC, as well as all other Federal agencies, would be bound by any such arrangement.

_.S . 1521 is a comprehensive bill covering many aspects of radio-active waste management. It would extend NRC licensing authority to all new DOE facilities for the storage or disposal of high- -

_ level waste, low-level waste, transuratile waste, radioact_ive_

gases and d_ecommissioned'fTcilltles including such materials le_nerated by forei g activities, research and develooment nrograms, and defense programs. Existing DOE facilities would require  ;

remedial action concurred in by the Commission. In addition, S.

1521 would impose a new standard for licensing waste facilities,

_) impose additional alternative site requirements beyond those in bbra, and authorize a State veto over NRC licenses for waste TatT1IYles, c.

Ibal would also require a joint NRC-EPA adjudi-catory_pyoceeding to determine if disposal technology evints, and in the event or a negative determination would require a moratorium on NRC issuance of construction permits and operating licenses.

By 1987 the NRC, in consultation with DOE, wpuld have to determine if adeauate disposal capacity will be available by 1990 for all ,

waste generated oy that date.

In the event of a ne6ative determina-tion, the Commission would be required to suspend __all commercial l generation or wastes unti~1 such disposal capacity would become iB/a11alTe . Thr NRC would not be authorized to license any DOE away-from-reactor facility for storing spent fuel until a permanent disposal facility for such material is in operation.
