The fire was reported to be a blue flame, about two inches high, at the exit of a one inch pipe attached to a flange cover plate connected to a vent line used to vent open systems during RCS maintenance. The fire brigade responded to the call and extinguished the fire at 1530 hours0.0177 days <br />0.425 hours <br />0.00253 weeks <br />5.82165e-4 months <br />. The licensee declared an Unusual Event in accordance with emergency procedures at 1523 hours0.0176 days <br />0.423 hours <br />0.00252 weeks <br />5.795015e-4 months <br />. The Unusual Event was terminated at 1643 hours0.019 days <br />0.456 hours <br />0.00272 weeks <br />6.251615e-4 months <br />.

The source of the flame was determined to be a lco concentration of hydrogen gas in nitrogen, leaking from the pressurizer relief tank (PRT) and out of the vent line used for venting when RCS maintenance work is perfonned. The hydrogen gas was ignited by a welding spark. The hydrogen gas in the PRT was a nonnal occurrence due to operators raising the water level in the pressurizer in preparation for maintenance activities which required opening the RCS.

No personnel were injured. Also, no equipment was damaged. Region II and NRR are following up on the event.

Babcock & Wilcox, Pennsylvania Operations IMPS staff met with R. L. Bruce, Manager of Nuclear Operations and Administration for R&W's Nuclear Power Division, and other BAW management to discuss the company's plans for use of the Apollo, Pennsylvania, facility.

Mr. Bruce stated the company's commitment to resolve the problems at this facility, particularly those related to soil contamination levels above NRC's guidelines for urrestricted use. He informed the staff that the proposed activities at Apollo will include methuds testing for contaminated soil cleanup, temporary storage of contaminated soil, and staging and storage of nuclear reactor components and equipment which are being decontaminated and refurbished at the company's Parks Township, Pennsylvania, facility. B&W plans to revise its application for licensing renewal to incorporate these activities and to delete its previous proposal to conduct nuclear service work on reactor components at the Apollo facility, similar to work now performed at Parks Township. The revised renewal application is expected in about two months.

GAO Audit of Military Master Broad Licenses On May 25, 1988, representatives from GAO met with HMSS staff to discuss their upcoming audit of the Mil itary Master Broad Licenses. Their audit will include the Air Force and Navy Master Broad Licenses and the individual licenses issued to the' Army. The audit will be done over the next several months, with visits to Regions 11 and IV.

Two attempts have been made to repair the leak at a T joint in the 3" piping. Each repair effort has failed the subsequent radiography. The licensee now intends to cut l out a section of the piping and make the repair with replacement pipe. j Repairs to the 2N21-F0068 valve were completed on 5/21/88. OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending May 27, 1988 SAFEGUARDS Domestic Meeting with Nuclear Fuel Services May 23, 1988 Nuclear Fuel Services met with the Licensing Branch, SGTR to report on safeguards mattu's at their Erwin, Tennessee facility. Discussion points

included comparability issues of the modification of the new entry control point and the detection of explosives in hand carried packages as well as the status of the High Enriched Uranium Recovery Facility, the Pu laboratory decomissioning project, and the applicability of the fitness for duty rule to a Category I fuel facility. Special staff attention will be given to physical security measures and controls taken during the Pu laboratory decommissioning as further information on anticipated Pu processing holdup is developed. NFS is progressing satisfactorily on all comparability issues.

Transportation  !

Meeting with DOE on Source Term Evaluation Members of the Transportation Branch, SGTR, met with representatives from DOE and Sandia on May 17, 1988 to discuss DOE's program for evaluating source tenns for containment. The program would attempt to quantify sources of radioactivity within sper.> fuel casks and to evaluate their potential for release under normal and .. ident conditions of transport. The results would be used to develop a computer code which could evaluate the containment of spent fuel casks.

Shipments of HEU from Oak Ridge Based on recent conversations with the DOE Oak Ridge Operations Office, eight Category II export shipments to Canada are still being held-up. Oak Ridge advises that they are still waiting on instructions from DOE Headquarters.

DOE Office of Safeguards and Security has prepared a draft response advising Oak Ridge how to proceed on this matter.

INDUSTRIAL AND MEDICAL NilCLEAR SAFETY Fuel Cycle Safety Babcock & Wilcox, Pennsylvania Operations IMNS staff met with R. L. Bruce, Manager of Nuclear Operations and Administration for B&W's Nuclear Power Division, and other B&W management to discuss the company's plans for use of the Apollo, Pennsylvania, facility.

Dry Cask Spent Fuel Storage On May 18, 1988, NMSS staff met with representatives of Nuclear Assurance Corporation (NAC) relative to their plans to submit a topical report (TR) for a storage cask with a capacity of 31 PWR assemblies. The cask body is the ,

same design submitted previously for the NAC Storage / Transport cask (capacity l 26 PWR assemblies), a stainless steel and lead cask with a solid neutron shield.

However, a new cask fuel basket is designed to take allowance for burnup credit. ,

I NAC expects to submit this TR in mid-July 1988.

Subsequently, NAC plans to resubmit its cask design for storage of consolidated fuel rods. There are 28 positions for storage of fuel rods from 56 PWR assemblies in this cask design's fuel basket. Storage of this amount of consolidated fuel is less reactive than storage of 28 corresponding intact fuel assemblies when water is present in the cask cavity. NAC intends to seek TR approval for storage of 28 intact PWR fuel assemblies taking credit for burnup allowance in a revised criticality design. Submittal of this TR is planned for mid-October 1988.

On May 20, 1988, NRC staff met with Nuclear Packaging, Inc. (NuPac) to discuss NuPac's concrete cask design topical report (TR). The concrete cask design, model CP-9, in NuPac's submitted TR would experience temperatures in concrete exceeding 150'F. Use of concrete standards, in particular ACI 349-80, were discussed. NuPac presented a proposed resolution for concrete temperature concerns. NuPac will submit its analysis as part of this review shortly.

Materials Licensing GA0 Audit of Military Master Broad Licenses On May 25, 1988, representatives from GAO met with NMSS staff to discuss their upcoming audit of the Military Master Broad Licenses. Their audit will include the Air Force and Navy Master Broad Licenses and the individual licenses issued to the Army. The audit will be done over the next several months, with visits to Regions II and IV.

LOW-LEVEL WASTE MANAGEMENT Low-level Waste Low-level Waste Training Videotapes The Department of Energy (DOE) has developed a series of training videotapes on low-level radioactive waste. The series was developed primarily to provide a tutorial for State and other technical staff involved in developing new disposal facilities. They provide an overview of the generation and properties of low-level wastes, 10 CFR Part 61, NRC's licensing process, and current statutes and issues.

DOE provided NRC a copy and copies have been made and provided to the five regional offices and GPA for in-house training use and loan to States or members of the public. NRC staff participated in the development of the tapes and appear in them.

Quality Assurance Workshops On May 23-24, representatives of the Regulatory Branch for Low-Level Waste Management and Decommissioning met with EG&G and CER Corporation to discuss and finalize the presentation for the Quality Assurance Workshops for Low-Level Waste Disposal Facilities. The workshops will focus on NUREG-1293 "Quality Assurance Guidance for Low-Level Radioactive Waste Disposal Facility."

NRC will be conducting several QA workshops with EG&G during the next few I months. The states of Petinsylvania, New York, New Jersey, North Carolina and 1 Nebraska have requested this workshop be conducted.

Request from the News and Observer On May 25, 1988, a science writer for the News and Observer of Raleigh, NC requested information on engineering alternatives for LLW disposal. Edgecombe County, in North Carolina is considering volunteering to host a waste disposal park. This would include an incinerator, LLW municipal waste and hazardous i waste disposal. A public meeting was scheduled for May 26, 1988. l l

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending May 27, 1988 Diagnostic Evaluation and Incident Investigation On May 26. the NRC team evaluating the ENERCON Independent Management Appraisal (IMA) Sf Turkey Point and Florida Power and Light (FP&L) met in Bethesda with the IMA team manager and several IMA team leaders to present and discuss the key significant issues identified by the NRC team during its review.

The infonnation and perspectives provided by the IMA assisted the NRC team in concluding its evaluation of the ENERCON effort. On May 27, the Director, AE0D, Division Director, D0A (Team Manager) and Chief, DEIIB (Deputy Team Manager) met with the Executive Director for Operations, the Administrator, Region II, and the Director, NRR to present a summary of the findings, conclusions, and recomendations of the NRC team's evaluation.

Incident Response On May for the 24-26, Federal IRB staff Emergency membersAgency Management gave a 2-day (course to state and local officialsFEM Institute. The course dealt with Reactor Systems, Severe Accidents, Event Classification, Protective Action Decisionmaking, and Source Team Estimation.

On May 24-26, IRB staff conducted technical exercises for 1 day for Region I and for 2 days at Headquarters, using an accident scenario developed by the Idaho National Engineering Laboratory (INEL) on their Nuclear Power Plant Analyzer.

The objective was to challenge the technical skills of the reactor safety and protective measures teams against a technically accurate scenario.

On May 27, the Director, AE0D and Chief, IRB conducted a tour and briefing of the Incident Response Center for Dr. Rene' Le'vesque, President of the Canadian Atomic Energy Central Board (AECB).

On May 24-26, IRB conducted an assessment of the Region V incident response ,

capabilities and procedures. '

Safety Programs AE0D staff met with Mr. George Ishack of the Nuclear Energy Agency at ORNL on May 25, 1988, to discuss AE0D/0RNL data base projects. In particular the Foreign Events File, which is managed by ORNL for AE0D, is of interest to NEA since it provides a centralized collection of international event data. On May 26, Mr. Ishack met with Division personnel to discuss areas involving human factors to which AEOD could contribute data and assessment capabilities.

2-The staff met with representatives of the BWR Owners Group (BWROG) the BWROG Scram Frequency Reduction (SFR) Committee, and GE to discuss the status of scram reduction efforts. The SFR chairman expressed intenst in continued comunication on scram reduction and in cooperation on mutually beneficial projects.

Critical Mass brought court action against NRC to obtain proprietary INP0 documents. The second set of interrogatories, which are very extensive, was due May 26, 1988. AE00 worked closely with OGC and a Department of Justice lawyer to meet the filing date. Any NRC staff person who would like to review the report or read an executive summary may obtain a copy from GPA/IP.

USSR AND HUNGARIAN OSART Mr. Stewart Ebneter, Director of the Office of Special Projects, will be the U.S. operations expert on the IAEA Operational Safety Review Team which will go to the Rovno Nuclear Power Plant in the Soviet Union in December 1988.

John Philip Stohr, Director of the Division of Radiation Safety and Safeguards in Region II, is being nominated to be the emergency planning and preparedness expert on the 0SART which will inspect the PAKS plant in Hungary November 14-December 2, 1988.

Foreign Visitors On Wednesday Mr. Alkut Aytern of the Building ResEarch Institute of the Scientific and Technical Research Council of Turkey met with Leon Reiter, NRR, to discuss ground motion.

On Thursday R. Hauber and M. Congdon met with George Ishack of the OECD Nuclear Energy Agency (Paris, France) to discuss the respective NRC and NEA foreign incident data bases at Oak Ridge and Saclay, France. Of mutual interest was the possibility of in-kind support from NRC to the NEA incident reporting system. NEA's current activities related to incident analysis and human factors were also discussed with Mr. Ishack.

On Thursday and Friday RES and GPA staff members attended the Fourth Annual Meeting of the American Institute on Taiwan (AIT) and Coordinating Council for North American Affairs (CCNAA) Joint Comittee on Civil Nuclear Cooperation. Following the keynote presentation by Victor Stello on the status of the U.S. nuclear power industry and NRC programs, and technical presentations by both sides, the matrix of AIT-CCNAA working items was updated.

On Friday Dr. Rene Levesque, President of the Canadian Atomic Energy Control Board (AECB), and Toma Diamantstein, Sr. Coordination Officer of the AECB Planning and Coordination Section, met with Chairman Zech and discussed, among other topics, the prospects for a formal bilateral agreement between the AECB and the NRC. STATE, LOCAL AND INDIAN TRIBE PROGRAMS Emergency Planning Exercise at Vogtle During the period May 23-25, 1988, Robert E. Trojanowski, Director, State and Government Affairs Staff, Region II, participated as a member of the Regional Assistance Comittee in the Plant Vogtle nuclear exercise.

Off-site agencies involved in this exercise included the States of Georgia and South Carolina and applicable local governments, as well as representatives from the DOE Savannah River Plant. The performance of the licensee and all of the off-site agencies was exceptional and neither NRC nor FEMA noted any major deficiencies.

A number of specific issues were discussed, including staff mobility, entry level hiring, training and personnel data reports. The principal focus for one full day was the NRC drug testing plan. This session was attended by the Directors, Division of Resource Management and Administration, from each Region who will play an integral role as Assistant Drug Program Coordinators.

Office of Enforcement Items of Interest Week Ending May 27, 1988 The following Significant Enforcement Action was taken the week of May 23, 1988.

An Imposition of Civil Penalty in the amount of $100,000 was issued to Commonwealth Edison Company (Zion, Units 1 and 2. The action was based on inadequacies in the licensee's program and controls for the testing of pressure isolation valves. The licensee responded to the Notice in

l ITEMS OF INTEREST OFFICE OF THE EXECUTIVE DIRECTOR FOR OPERATIONS Week Ending May 27, 1988 Proposed Rule Signed by EDO On May 23, 1988, the Executive Director for Operations approved a proposed rule to revise 10 CFR Part 71, "Packaging and Transportation of Radioactive Material." The rulemaking action, in combination with a parallel action by the U.S. Department of Transportation, would make United States domestic rules for the transporation of radioactive material compatible with those of the International Atomic Energy Agency (IAEA) and thus with those of the international community.

This constitutes notice to the Commission that, in accordance with the rulemaking authority delegated to EDO, the EDO has signed this proposed rule for publication in the Federal , Register.

SECY-88-119 - Motion to Modify or Quash subpoenas in Parley Nuclear Plant Investigation The Commission, by a 5-0* vote, approved an order which responded to an April 27, 1988, letter asking the Commission to mo'dify or quash OI subpoenas issued on April 13, 1988, to 11 non-supervisory employees at the Farley Nuclear Power Plant. The order denied the motion to quash but did modify the subpoenas in part to better specify the documents to be. produced.

In acting on the order the Commission noted that the issues raised in the motion to quash are related to ones which the Commission directed OI in March 1987 to address promptly in i

completing its final draft of the 01 procedures manual. (See SRM on COMLZ-87-6 dated March 24, 1987.) The OI procedures manual should be completed in accordance with the March 24, 1987, SRM and returned to the Commission for review.

Finally the Commission was not provided advance notice of issuance of the subpoenas as required by the delegation of subpoena authority in NRC Manual Chapter 0119-039. The staff is reminded that the Commission should have been informed when the subpoenas were issued on April 13 rather than upon receipt of a motion to quash three weeks later; particularly where the issue has been subject to continued Congressional interest.

$5841, provides that action of the Commission shall be deter- I mined by a "majority vote of the members present." commissioner Rogers was not present when this item was affirmed. Accordingly the formal vote of the Commission was 4-0 in favor of the decision. Commissioner Rogers, however, had previously indicated l that he would approve this paper and had he been present he would have affirmed his prior vote.
