REQUEST FOR ASSISTANCE IN FULFILLING STAFF REQUIREMENTS HEHORANDUM ADDRESSING STORAGE OF LOW-LEVEL RADIOACTIVE WASTE

Paperiello dated 2/24/92, same subject In the referenced memorandum, you requested that we provide information regarding: (1) the identity of Region III licensees who have requested a license or license amendment before March 1,1992, authorizing storage of low-level waste; (2) the number of-those; requests that have been granted; and (3) the adequacy of guidance on licensing requirements for low-level waste storage.

Regarding reactor licensees, we-do not anticipate that any of our licensees for power or non-power reactors will submit an amendment request for authorization of interim storage of low-level waste.

We anticipate that the licensees will handle these f acility changes ,

under the 10 CFR 50.59 evaluation process. Regional inspectors q-normally review 10 CFR 50.59 evaluations for adequacy;-however, we are concerned that there have not been-clearly articulated minimum standards for low-level waste storage f acility design. Two generic letters (GL 81-38 and GL 85-14) have provided_non-binding guidance

' cn-this matter, r We recommend that minimum facility design specifications _be established and communicated to the . licensees. Those specifications and corresponding inspection guidance should be incorporated into the NRC Inspection Manual to f acilitate regional-review of these issues. Another alternative is that each facility design could be submitted to NRR/NHSS for technical review. .We l

believe that this approach could be arduous and result in untimely reviews. Regardless of the approach, thorough review ' of' these-

Regarding materials licensees, we have received seven applications for amendment to authorize interim low-level waste storage (Enclosure 3). Six of those applications have been approved and the seventh review is scheduled to be approved in April 1992.

Adequate guidance for submitting and reviewing these actions is contained in Information Notice 90-09 and Policy and Guidance Directive FC 90-03. The Licensing Tracking System (LTS) has recently been modified with four fields addressing various waste storage issues including interim storage and decay in storage.

That information is accessible in headquarters at any time. If you have any questions regarding the data we enter into the LTS, please contact Mike McCann (388-5741) or Marcia Pearson (388-5605).
