H.R. 5934, THE " CONSUMER-PATIENT RADIATION HEALTH AND SAFETY ACT OF 1979" Thank you for bringing H.R. 5934 to r,y attention. There is a serious flaw in tnis proposed legislation because it would further fragment the Federal regulation of ionizing radiation. In particular, lines 8, 9 and 10 on page to E c f all develop the subject bill would trans fer to the Secretary of HEW the authority Feceral radiation guidance fcr consumer-patient exposure from nedical sources of ionizing radiation. The Federal guidance authority for all sources of ionizing radiation had been transferred from HEW to EPA under the President's Reorganiza tion Flan 3 o f 1970. More significantly, H.R. 593a would undermine a reconstitution of the Federai Radiation Council (FRC) function whi:h has been recontended by recent congressionci evoluttions (See prepcsed S.1938 enclosed) and ty the Litassi Conmittee.
