The enclosed report (Case No. 1-90-018) is the result of an investigation conducted by the NRC Office of Investigations (01) concerning the Albany Veterans Administration Medical Center (VAMC), an NRC licensee located in Albany, New York. This matter is being referred to your office because evidence was developed indicating potential violations of 18 U.S.C.1001 and NRC regulations 10 CFR 30.9 and 10 CFR 35.59(g).. 10 CFR 35.59(g)_.is issued under subsections 161(b) and (o) and 10 CFR 30.9 is issued under subsection 161(o) of the Atomic Energy Act-(AEA), as amended'(42 U.S.C. 2201).. Section-223 of the AEA (42 U.S.C. 2273) makes a willful violation of. any regulation 4
issued under subsections 161(b), (1) or (o) of the 'AEA a criminal act.
This investigation was predicated upon concerns raised by' _the NRC technical staff that an NRC licensed Radiation Safety Officer (RS0) provided false, inaccurate, or incomplete. infomation to an NRC inspector during an inspection conducted on November 20 and 21, 1900. Specifically, the RSO submitted a falsified quarterly' radioactive sealed source inventory dated October 14, 1990, as well as the records for the three previous 1990 quarterly _
inventories. The investigation disclosed that the inventories were _
deliberately falsified, in that they were not conducted as required but signed by the RSO as having.been completed.-
In view of the evidence of possible Federal criminal violations. this report and exhibits, including sworn statements, are being forwarded to you for prosecutorial consideration and whatever action you deem appropriate.
