Facility Operating Licenses No. DPR-80 and DPR-82 January 27, 1993 Notico of Hearina On July 22, 1992, the Nuclear Regulatory Commission published in the Federal Registor a notice of opportunity for hearing with respect to proposed operating-license amendments that would extend the operating licenses for the Diablo Canyon Nuclear Power Plant, Unita 1 and 2, located in San Luis Obispo County, California, to recover or recapture into the licenses the period of construction of the reactors (57 Fed. Reg. 32571, 32575). The amendments would oxtend the expiration date of the Unit i license from April 23, 2008 to September 21, 2021, and the expiration dato of the Unit 2 license from December 9, 2010 to April 26, 2025.

one request for a hearing and petition for leave to intervene, filed by-San Luis Obispo Mothers for Peace, was received. On September 10, 1992, an Atomic Safety and Licensing Board was established to rule on this h request / petition and to preside over the proceeding in the event that a hearing were ordered. 57 Fed. Reg. 43035 (September 17, 1992). The Licensing Board is comprised of Dr. Jerry R. Kline, Frederick J, Shon, and Charles Bechhoefer, Chairman of the Board.

After holding a prehearing conference in San Luis obispo, California, the Atomic Safety and Licensing Board issued a Prehearing Conference order (LBP-93-1) on January 21, 1993, granting the request / petition. San Luis obispo Mothers for Peace was admitted as a party and, pursuant to its request, the' State of California Public Utilities Commission was permitted to participate as an Interested State pursuant to 10 C.F.R. S 2.715(c).

Please take notice that a hearing will be conducted in this proceeding. The hearing is authorized by 10 C.F.R.

SS 50.58(b) (2) , 50.90 and 50.92. Matters at issue are the two safety issues accepted by the Licensing Board in LBP-93-1.

During the course of the proceeding, the Board may hold further prehearing conferences, pursuant to 10 C.F.R.

S 2.752, as well as evidentiary hearing sessions, at times and places to be hereafter announced, through notices to be

4 published in the Federal Register and/or made available to the public at the Public Document Rooms. Supplementing the opportunity afforded at the first prehearing conference, l during some or all of these sessions, and in accordance with 10 C.F.R. S 2.715(a), any person, not a party to the proceeding, will be permitted to make a limited appearance statement either orally or in writing, setting forth his or her position en the issues. These statements do not j constitute testimony or evidence but may assist the Board and/or parties in the definition of issues being considered.

The number of persons making oral statements and the time l allotted for each statement may be limited depending upon the time available at various sessions and whether or not the person seeking to make such a statement previously was permitted to do so. (Normally, oral- statements may extend for up to five minutes.) Written statements may be

, submitted at any time. Persons desiring to make a limited l-

appearance are requested to inform the Office of=the Secretary, Docketing and Service Branch, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555. A copy of such statement or request should also be served on the Chairman of the Licensing Board.
