Dear Mr. Rael:

On September 30, 1996, the U.S. Nuclear Regulatory Commission notified the U.S. Department of Energy (DOE), Uranium Hill Tailings Remedial f.ction Project Office, of.the completion of the NRC staff's review of the final Remedial Action Plan (RAP) and all; associated documents pertinent to the proposed remedial action;t the inactive uranium mill tailings site at Slick Rock,  !

Colorado (letter from Holonich to Sena). The staff's review was documented in i

the Final Technical Evaluation Report for the Slick Rock site, transmitted via the September 1995 letter.

I have signed the original signatufe pages (three copies enclosed) signifying the NRC's concurrence in the Slick Rock RAP. These pages were transmitted far i NRC's ::ignature and incorporation into the RAP by your letter of April 10, 1997. NRC's concurrence signifies that DOE's proposed remedial action complies with the 40 CFR Part 192, Subparts A-C, standards of the U.S. Environmental Protection Agency, with the exception of selection and l

performance of a groundwater cleanup program. . DOE has proposed deferral of this aspect of the remedial action at this time and plans to handle this action in the separate groundwater program. NRC considers the deferral to be acceptable; therefore, NRC's concurrence in the RAP does not include l

groundwater remediation. '
