Dear Mr. Chairman:

Enclosed for the information of the subcommittee is a copy of the proposed amendment to 10 CFR Parts 50 and 73 to be published for public comment in the Federal Reaister.

This proposed amendment was developed in response to )etitions for rulemaking submitted by Virginia Power Company. PRM 50 59 and PRi 50-60. Specifically, the proposed change would require that nuclear power reactor licensees conduct program reviews and audits of their emergency preparedness programs, safeguards contingency plans, and physical security programs as needed in response to program performance indicators, after a significant change occurs in personnel, procedures, equipment, or facilities. but in no case less frequently than every 24 months, instead of every 12 months as presently l' required. This action will make these reviews and audits performance based rather than compliance based, better ensuring that changes do not adversely affect the operation of program elements or functions, and reducing the regulatory burden on licensees without compromising public health and safety.
