13 MR. HOYLE: The first item is SECY 96-268. This 14 paper presents an immediately effective final rule amending 15 10 CFR Part 71 to correct a recently discovered defect in I 16 the rule for shipments of fissile material. i 17 All of you have voted to approve the publication 18 of this final rule.

e 1 Native Americans for a Clean Environment and the Cherokee 2 Nation for Commission review of the Atomic Safety and 3 Licensing Board's memorandum and order of November 5 4 approving a settlement agreement between the NRC staff and 5 General Atomics.

6 All of you have voted to approve the order 7 granting the petitions for review and setting a briefing 8 schedule. May I ask you to affirm your votes?

15 COMMISSIONER McGAFFIGAN: Madam Chairman, could I 16 just say on the first item Babcock and Wilcox deserves some 17 real credit for bringing that issue to our attention and the 18 staff deserves a lot of credit for very promptly responding.

19 CHAIRMAN JACKSON: And we publicly thank both of 20 them, to the extent we have a public this morning.
