l We have reviewed the recently proposed amendments to the Department's rules entitled, l " Licensing Req'uirements for Source Material Milling Facilities," 32111. Adm. Code 332, submitted by Ms. Rose Miller, Legal Assistant, to Mr. James Lynch, Regional State Agreements Officer, NRC Region ill, on November 4,1996. The proposed amendments were reviewed by comparison with 10 CFR Part 40 and Appendix A to Part 40. In addition, we used SECY 90-253, " Proposed Amendment Number One to the Agreement Between the State of Illinois and U.S. Nuclear Regulatory Commission Pursuant to Section 274 of the Atomic Energy Act of 1954, As Amended," dated July 17,1990: 32 lilinois i

that Mr. Lynch and Dr. Sollenberger did a cursory review at the time of receipt, November 20,1996, and informed you that they did not see any problems with the proposed amendments., , , .. ,

As the result of our review we have'no com'ments. Under:our current procedure, a finding I

that a rule meets the compatibility requirements may only be made based on a review of the final text of the rule. However; we have' determined that if the proposed amendments

. were adopted without significant change, they~ would be compatible.

We request that when the proposed amendments are adopted and published as final rules, a copy of the "as published" rules be provided to us _for review. As requested in our All

. Agreement States Letter SP-96-027, " Request to Highlight Changes to Agreement State Regulations Submitted to NRC for Compatibility Review, " (March 1,1996), please ~
