'0RDER TERMINATING FACILITY LICENSE By application dated April 20,1981,'Batte11e Memorial I.nstitute requested termination of Facility License CX-26 for the Plutonium Recycle Facility (PRCF) now Richland, Washington. The tems and conditions of Facility ,

License CX-26 specify that the facility license will expire automatically upon termination of the licensee's authority under Contract AT(45-1)-1831

- (use permit) between the Commission (now DOE) and the licensee. In accordance with the terms and conditions of Facility License CX-26, this license has expired.

Since the PRCF is a government-owned facility in the custody of Battelle under its operating contract with the Department of Energy, all responsibility for health, safety and radiation protection is now under the control of the .

Department of Energy. -

Therefore, pursuant to the application by Battelle Memorial Institute, Facility License No. CX-26 is hereby teminated as of the d&te of this Order.

For further details with respect to this action, see (1) application for temination dated April 20, 1981. This application is available for public inspection at the Commission's Public Document Room,1717 H Street, N.W.,

\*'V pl SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING ORDER TERMINATING FACILITY LICENSE CX-26 BATTELLE MEMORIAL INSTITUTE PLUT0NIUM RECYCLE CRITICAL FACILITY (PRCF)

DOCKET NO.: 50-360 By application dated April 20, 1981, Battelle Memorial Institute req'nsted termination of License No. CX-26 for their Plutonium Recycle Critical Facility (PRCF). The Plutonium Recycle Critical Facility is a government owned facility in the custody of Battelle under its operating contract DE-AC-06-76 RLO 1830 with the Department of Energy.

On November 29, 1971, the U. S. Atomic Energy Commission now Nuclear Regulatory Commission issued Facility License CX-26 to Battelle Memorial Institute.

Battelle has conducted research and development activities using the PRCF under their use permit and Facility License CX-26 through March 11, 1976. Since March 11, 1976, Battelle has not used the PRCF under the Use Permit and coes not contemplate using the PRCF in the future.

On April 17, 1981, the Use Permit was amended to terminate Battelle's authority to use the PRCF for its own account.

Since paragraph 2.D of Facility License CX-26 states: "This license is effective as of the date of issuance and should expire at midnight November 29, 2011; provided, however, that this license shall in any event expire automatically upon termination of the licensee's authority under Cor: tract AT(45-1)-1831 (use permit) between the Commission and the licensee, (i.e.,

Atomic Energy Commission-now Department of Energy) to use the facility in conducting research and development activities for its own account."

In accordance with the above, Facility License CX-26 has expired. With the expiration of Facility License CX-26, all NRC involvement and responsibility in connection with this license has ceased. Since the PRCF remains a government (DOE) owned facility in the custody of Battelle under its operating Contract with the Department of Energy, all responsibility for he aith and safety and radiation protection now rests with the Department of Crtrgy.

Since this action is administrative in nature in that the responsibility for health and safety radiation protection passes to the Department of Energy upon termination of Facility License CX-26, we have concluded that

- termination of this license does not involve (1) a significant increase in the probability or consequences of accidents previously considered, does not

~

involve a significant decrease in a safety margin, and, therefore, does not involve a significant hazards consideration and (2) there is reasonable assurance that the health and safety of the public will not be endangered by this actinn.

- We have determined that this termination will not result in any significant environmental impact and that it does not constitute a major Commission action significantly affecting the quality of the human environment.

"We have also determined that this action is not one of those covered by 10 CFR 51.5(a) or (b). Having made these determinations, we have further concluded that, pursuant to 10 CFR Sl.5(d)(4), an environmental impact and negative declaration need not be prepared in connection with issuance of this termination.
