UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION In the Matter of EXELON GENERATION COMPANY, LLC Docket Nos. 50-289 50-320 (Three Mile Island Nuclear Station, Units 1 and 2)
ORDER On January 23, 2020 the Atomic Safety and Licensing Board denied the petition to intervene and request for a hearing in this proceeding filed by Eric J. Epstein and Three Mile Island Alert, Inc. (Petitioners). 1 On February 16, 2020, Petitioners filed a Motion to Stay Memorandum and Reply to Proposed Order Denying Intervention and Petition before the Board. On February 19, 2020, the Board denied the motion to stay and, to the extent the petitioners motion could be considered an appeal, referred it to the Commission. 2 The NRC Staff has filed a Motion for Clarification of the time to respond to Petitioners pleading. Pursuant to my authority under 10 C.F.R. § 2.346(a), the time for the Staff and Applicant, Exelon Generation Company, LLC to respond to the motion is March 12, 2020.
