LICENSEE'S RESPONSE TO UCS' MOTION CONTAINED IN UCS' RESPONSE TO STAFF MOTION FOR EXTENSION OF TIME TO RESPOND TO THE BOARD'S CLASS 9 QUESTIONS On April 15, 1980, the NRC Staff requested an extension of hime to June 1, 1980, to answer the Board's Memorandum and Order to NRC Staff Regarding Class 9 Events, dated March 31, 1980. On April 18, 1980, UCS filed a response requesting the Board to permit the extension "on the basis that the parties will have until June 15, 1980, to file discovery requests on the staff's response."

The UCS response, while couched in terms of a response to the Staff request, amounts to a motion by UCS to enlarge the discovery opportunities previously provided by the Board.

UCS' request should be denied as premature and for failure-to show good cause. It cannot now be presumed that the Staff response to the Board will produce new grounds for discovery.

Further, any request which UCS may maka to extend recuests for discovery as late as June 15, 1980, should be considered by the Board in the context of the hearing schedule at that time, including the need for discovery adequately to prepare for the hearing and the impact which UCS claims its discovery should have on the hearing schedule.
