UNIT 1 - APPLICATION FOR EXTENSION OF CONSTRUCTION PERMIT COMPLETION DATE

Dear Mr.-Denton:

This letter is being submitted at the request of Irving ,

Peltier, NRC Project Manager for the Wm. H. Zimmer Nuclear Power Station. He requested that the information contained in our February 8, 1980 application.for extension of the construction permit completion date be updated. As you will recall, our February 8, 1980 letter stated that the construction of the Zimmer Station could not be expected to be completed and an operating license issued by April 1, 1980 due to circumstances beyond the

control of the Applicants and requested that the latest completion date specified in the construction permit be changed to November 30, ,

1981. The application noted that the' accident at the Three Mile Island Nuclear Station, Unit 2 had virtually brought the NRC licensing proce'ss to a halt and that the Commission had not

[ completed its own evaluation of this matter nor reviewed the r various ongoing outside investigatior.s of the accident. The submittal also stated that it appeared that a broad spectrum of additional requirements would be imposed on licensees and substantial delays would occur. Finally, that letter noted that even after the Commission had established all critoria for re- -

sumption of licens'ng and the Staff was satisfied with the Applicants' implementation of the NRC's new requirements, hear-ings before an Atomic Safety and Licensing Board _would have to take place prior to the issuance of an operating license for the Zimmer Station.

The-length of the original application for extension was based upon the statement of the then Chairman _of the NT.0,

Zimmer Nuclear Power Station - Page #2 Unit 1 - Application for Extension of Construction Permit Completion Date Since that time, additional circumstances beyond the control of the applicant have occurred which indicate that a period of time even beyond that originally contemplated by the Applicants must be allotted to assure sufficient time for the issuance of an operating license prior to the expiration of the construction permit. The Applicants are presently dis-cussing with cognizant governmental authorities the implementation of new NRC and FEMA requirements regarding emergency planning evolving from the TMI accident. While significant progress has been made in these discussions, it is recognized that there may be some delay in reaching agreement with these governmental authorities with regard to implementation of the requirements of NRC and FEMA. Subsequent to that time, additional-procedurec will have to be developed and certain facilities and equipment designed, procured, constructed, installed and tested by the governmental entities and by the Applicant.

It is noted that since our letter of February 8, 1980, the presiding Licensing Board has granted a late-filed petition for leave to intervene filed by Zimmer Area Citizens and Zimmer Area Citizens of Kentucky ("ZAC/ZACK") and has admitted Clermont

! County, Ohio and the City of Mentor, Kentucky as participants

. in the proceeding pursuant-to 10 C.F.R. Section 2.715(c). With regard to the ZAC/ZACK intervenors, the Board has admitted i

thirteen new contentions, some with numerous subparts, specifically relating to emergency planning, thereby complicating the proceeding l and raising the potential.for significant delay.

I In his status report of January 31, 1981, to the Hon.

Tom Bevill, Chairman, Subcommittee on Energy and Water Development, l Committee on Appropriations, John F. Ahearne, then Chairman of the l Nuclear Regulatory Commission, reported that "(a) Commission decision

.on a full power license is expected in July 1982" approximately eight months later than was previously projected by the NRC. We do not agree that the hearing process-should be permitted to delay and are hopeful that steps can be taken to eliminate the NRC's pre-dicted additional delay. However, with such predicated-delays being beyond the control of the Applicants, we would deem it prudent to
