Dear Mr. Killar:

The purpose of this letter is to inform the Nuclear Energy Institute (NEI) of the U. S. Nuclear Regulatory Commission (NRC) plans to review and update its Regulatory Guides through the Regulatory Guide Update Program (RGUP). This effort was undertaken in response to Commission direction, the details of which are discussed in SECY-07-0208, AProposal for Updating Office of Nuclear Material Safety and Safeguards - Cognizant Regulatory Guides,@

dated November 30, 2007 (ML073200035).

During its review of the Agency=s infrastructure to support new reactor licensing activities, the Commission identified a need to focus on a total of 480 regulatory guides for review, update, or withdrawal. Within this group, approximately 60 regulatory guides support the Office of Nuclear Material Safety and Safeguards (NMSS) fuel cycle facility program. The regulatory guides involve material control and accounting, licensing, criticality, and fire protection activities. The majority of these regulatory guides were issued in the 1970s, and there is a need, among other things, to revisit these guides for applicability, completeness, accuracy, and inter-document references and conflicts with current NRC guidance. To accomplish this goal, NMSS in conjunction with the Office of Nuclear Regulatory Research has implemented a 63-week process for review, updating, or withdrawal of these guides. During this process, draft regulatory guides are placed in the Federal Register for public comment. We would encourage your review and comment on these draft guides.

To keep the Commission, other interested parties, and the public informed about the status of these update efforts for fuel cycle facilities, the NRC has established several links on its public web-site for this information. These can be found at:
