NOTIFICATION OF TERMINATION OF NEED FOR FEDERAL EMERGENCY MANAGEMENT AGENCY SUPPORT FOR THE REVIEW OF CERTAIN NEW REACTOR LICENSING ACTIONS

Dear Mr. Hart:

During a December 19, 2017, meeting between the Nuclear Regulatory Commission (NRC) staff and Mr. Duane Jenkins (Chief, Business Operations Branch / Technological Hazards Division), it was identified that the Federal Emergency Management Agency (FEMA) continues to assess a new reactor user fee under Title 44, Emergency Management and Assistance, of the Code of Federal Regulations (44 CFR) Part 353 for new reactor licensing actions that have been completed, or formally terminated or suspended. This letter serves as written notice that support under Memorandum of Understanding Between the Department of Homeland Security/Federal Emergency Management Agency and Nuclear Regulatory Commission Regarding Radiological Emergency Response, Planning and Preparedness (Agencywide Documents Access and Management System (ADAMS) Accession No. ML15344A371), for the technical review of proposed offsite radiological emergency preparedness (REP) plans and preparedness, is no longer required for the new reactor licensing actions listed below until further notification by NRC.

Combined License (COL) Actions - FEMA Review Completed

  • Enrico Fermi Nuclear Plant, Unit 3: COL issued on May 1, 2015 (ADAMS Accession No.

  • North Anna Power Station, Unit 3: COL issued on June 8, 2017 (ADAMS Accession No.

  • Turkey Point, Units 6 and 7: Mandatory licensing hearing held on December 12, 2017, and awaiting Commission decision on issuance of COL.
