3 JUDGE HAWKENS: My name's Roy Hawkens, I'm 4 a Licensing Board Chairman in this case, which is 5 entitled Florida Power & Light Company Turkey Point 6 Units 3 & 4. Docket number is 50-250-LSR and 50-251-7 LSR -- SLR.

8 I'm joined by Dr. Sue Abreu and by the 9 Board's Law Clerk, Sara Ladin. The third Board 10 member, Dr. Mike Kennedy, had an arising issue at home 11 which prevents him from joining us, but he's 12 authorized Dr. Abreu and me to go forward with this 13 teleconference.

14 Would the counsel for the parties please 15 introduce themselves for the record.

16 MR. BESETTE: Your honor, this is Paul 17 Besette on behalf of Florida Power & Light, and I have 18 with me Steve Hamrick.

6 MR. AYRES: Your honor, this is Richard 7 Ayres, I represent Friends of the Earth.

8 MS. CURRAN: Good morning, Judge Hawkens, 9 this is Diane Curran for Southern Alliance for Clean 10 Energy.

11 JUDGE HAWKENS: Thank you, Ms. Curran.

12 MR. FETTUS: And good morning, your honor, 13 this is Geoffrey Fettus and I'm representing the 14 Natural Resources Defense Council.

15 JUDGE HAWKENS: Thank you, Mr. Fettus.

16 And Mr. Gomez, are you on the line also?

17 MR. GOMEZ: Good morning, Judge, yes, this 18 is Albert Gomez.

19 JUDGE HAWKENS: All right, thank you. To 20 assist the Court Reporter, when a counsel or 21 representative wishes to speak, please introduce 22 yourself prior to speaking. The Board has determined 23 that it will be conducting an oral argument in this 24 case, and the purpose of this teleconference is to 25 establish the venue and the date for the argument.

7 1 Prior to this teleconference, Ms. Ladin 2 polled you regarding where you would prefer the 3 argument to be held and your availability during three 4 different time periods, the week of November 5, the 5 week of November 26, and the week of December 3.

6 Regarding location, the majority of you 7 stated that you preferred or were willing to hold 8 argument near the Turkey Point facility. And the 9 Board therefore plans to hold the argument in the city 10 of Homestead at their council chambers, which is 11 located at 100 Civic Court in Homestead, FL.

12 Regarding the date of the oral argument, 13 during the timeframes that Ms. Ladin asked about your 14 availability, which was the week of November 5, 15 November 26, and December 3, there was not a time when 16 all the parties would be available. Because the 17 Board's not willing to delay oral argument beyond the 18 week of December 3, we will set argument for Tuesday, 19 December 4.

20 Now, the only entity that will not be 21 available for that date is Mr. Gomez. And by 22 targeting December 4, Mr. Gomez, that's two months 23 away, and if perhaps it will be possible for you to 24 arrange your schedule in order to attend.

8 1 wanted to assure you you would not be prejudiced, 2 because the purpose of oral argument is for the Board 3 to ask questions of the parties arising from the 4 written pleadings.

5 And if the Board has any questions for 6 you, it can send them to you in writing prior to the 7 argument, and we'll request for you to respond to them 8 in writing prior to the argument. But at this point, 9 the Board does not contemplate having any questions 10 for you.

11 Next week, the Board will issue a 12 scheduling order that will designate the date, time, 13 and location of the argument, the order in which the 14 parties will make their presentations, and the amount 15 of time allotted to each party.

16 Mr. Gomez, if you look at your schedule 17 and determine that you will be available to 18 participate in the argument, or Ms. Ladin has advised 19 me that you informed her that you may be obtaining 20 counsel, if you find that your counsel is able to 21 participate in argument on December 4, please 22 communicate with Ms. Ladin by either telephone or 23 email before close of business on Monday.

9 1 would like the parties to be prepared to focus on at 2 oral argument. Also prior to the oral argument, 3 likely in early November as well, perhaps late 4 October, the Board will issue an order that addresses 5 the motion to strike, as well as the alternative to 6 file supplemental pleadings.
