Dear Mr. Tarver,

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated June 28, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA) request seeking the Organizational Chart, Staff Roster of Yucca Mountain project. Specifically, you appealed the adequacy of NRC's search.

Acting on your appeal, I have reviewed the records for this case and have determined that, as stated in our final response to NRC-2018-000034 to you, the NRC is unable to locate any responsive records to your request. The agency informed you that the NRC adjudicatory proceeding for Yucca Mountain is currently suspended, therefore, NRC does not have an active Yucca Mountain project staff in the licensing office and does not have any documents (i.e. org charts for rosters) that are responsive to your request. Therefore, I have denied your appeal.

This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you can seek judicial review of this decision in a district court of the United States in the district in which you reside or have your principal place of business, in the district where the agency's records are situated, or in the District of Columbia.
