RESULTS OF PERIODIC REVIEW OF REGULATORY GUIDES This is in response to your April 8, 2019, memorandum requesting the Office of Nuclear Material Safety and Safeguards (NMSS) staff to perform a periodic review of selected Regulatory Guides (RGs) that support NMSS regulatory programs, as shown in Enclosure 1, Regulatory Guides That Are Due for a Periodic Review, of your memorandum. My staff coordinated with the NMSS divisions to respond to your request. Our results are provided in the enclosure to this memorandum.

As directed in Management Directive 6.6, Regulatory Guides, the NMSS staff conducted a review of RGs that were due for their 10-year periodic review or were known to require updated information. Enclosed are the results of the NMSS staffs review for RG 3.56, General Guidance for Designing, Testing, Operating, and Maintaining Emission Control Devices at Uranium Mills, RG 4.14, Radiological Effluent and Environmental Monitoring at Uranium Mills, and RG 8.30, Health Physics Surveys in Uranium Recovery Facilities, for your consideration and appropriate action.

The staff identified two RGs to be withdrawn. With regard to RG 6.2, Integrity and Test Specifications for Selected Brachytherapy Sources, the basis for withdrawal is being drafted. It will be provided to the Regulatory Guidance and Generic Issues Branch (RGGIB) by June 30, 2019. With regard to RG 6.9, Establishing Quality Assurance Programs for the Manufacturing and Distribution of Sealed Sources and Devices Containing Byproduct Material, the basis for withdrawal of this RG was provided by email to H. Karagiannis, of RGGIB on May 9, 2019.

B. Thomas 2 of your April 8, 2019, memorandum requested updated staff plans for the listed RGs. Periodic reviews including current plans for RG 3.48, Standard Format and Content for the Safety Analysis Report for an Independent Spent Fuel Storage Installation or Monitored Retrievable Storage Installation (Dry) Storage, and RG 3.61. Standard Format and Content for a Topical Safety Analysis Report for a Spent Fuel Dry Storage Cask, are included with this memorandum.

The staff also identified that RG 3.53, Applicability of Existing Regulatory Guides to the Design and Operation of an Independent Spent Fuel Storage Installation, listed on Enclosure 3 of your memorandum, should be withdrawn. The basis will be sent to RGGIB by May 30, 2019.
