Dear Mr. Fertel:

I am responding to the February 24, 2009, letter you sent to the U.S. Nuclear Regulatory Commission Chairman requesting that the proposed emergency preparedness (EP) rule be separated into two rulemaking actions. At this time, the proposed EP rule is with the Commission for approval and, per the rulemaking process, the staff is currently waiting for the results of their review. We appreciate your comment and if the proposed rule is issued, we will address your concern along with other stakeholder comments received during the comment period. If the proposed rule is issued, we plan to consider your comment under the section regarding the appropriateness of the proposed implementation schedule.
