Comments on 2021 Price-Anderson Act Report to Congress Date: Friday, June 9, 2023 8:04:56 AM Importance: High

Mr. Luehman,

I hope this email finds you well. I am writing to acknowledge the comments you provided on the U.S.

Nuclear Regulatory Commissions (NRCs) 2021 Price-Anderson Act (PAA) Report to Congress. We appreciate your dedication and effort in reviewing the report and sharing your valuable insights.

Furthermore, I want to thank you for providing a courtesy copy of the comments provided to the appropriate Congressional committees, sub-committees, and members. Your initiative in disseminating this information helps ensure that all relevant stakeholders have access to the important discussions surrounding the PAA.

At this time, the NRC does not anticipate revising the Report or its recommendations for the renewal of Price-Anderson until the Congress has had an opportunity to review and respond. We understand the significance of Congressional input and believe it is essential to consider their perspectives before making any revisions to the Report or modifications to the Act itself. The PAA is currently authorized through December 31, 2025. Considering the extensive nature of the report and the legislative process, it may take some time before we receive a response from Congress on the Report or the recommendations provided.

While the 2021 PAA Report is under review by Congress, the NRC staff is working diligently to establish regulations for new nuclear technologies, taking into account the Acts provisions and the associated financial protection requirements. We will continue to monitor the condition of the nuclear industry, availability of private insurance, and the state of knowledge concerning nuclear safety, and recognize that the PAA provides the NRC with discretion to address these requirements through rulemaking and guidance as needed.

Thank you once again for your comments and engagement in matters related to nuclear regulatory affairs.

Best regards,

Fred Miller Branch Chief Office of Nuclear Material Safety and Safeguards Division of Rulemaking, Environmental, and Financial Support Financial Assessment Branch (301) 415-6765
