Dear Mr. Markwell:

Your letter of March 13, 1995, provided partial response to our February 9, 1995, letter which requested additional information (RAI) for four (4) subject areas in order for us to continue the safety evaluation and registration of

  • l the propo. sed 500S and 200P series smoke detectors. There were primarily two  :

areas that you delayed responses. For prototype testing, you stated that you had not had a final prototype unit from which to test. For the quality assurance / control (QA/QC) program, you indicated that you had not contracted a manufacturer from which a quality control procedure can be for submittal.

l In the last two months, we have conversed a few times with each other over the telephone on your plan of submitting the remaining information. We haven't been successful in obtaining a definitive schedule from you for this effort.

As I explained to you that, in general, if no relevant response is received from an applicant over a prolonged period of time, the applicant's inaction l will be deemed as not being interested in pursuing further the request for safety evaluation and registration of a product. As a result, on the basis of the agreement over the telephone conversation with you on June 2, 1995, we hereby advise you that your request for the subject smoke detector models will be voided unless you submit the prototype test and QA/QC information by July

15. 1995. In that case, should a need to complete safety review arises in the future, you must submit a new request, and we will then treat the request as a new case according to our procedure for tracking licensing actions.
