REQUEST FOR REVIEW OF PRELIMINARY SAFETY ANALYSIS REPORT FOR THE COMMERCIAL LIGHT WATER REACTOR - TRITIUM EXTRACTION FACILITY

Dear Mr. Sohinki:

This is in response to your letter to Carl Paperiello of August 27,1999, in which you asked the '

Nuclear Regulatory Commission (NRC) staff to review the Preliminary Safety Analysis Report (PSAR) for the Commercial IJght Water Reactor - Tritium Extraction Facility. Unfortunately,  ;

l NRC lacks the staff resources to conduct a review of your PSAR and your comparison of l regulatory requirements and we will not be able to support this request.

l Incidentally, your letter indicated that your request is in accordance with the Memorandum of Understanding (MOU) dated May 22,1996, between the Department of Energy (DOE) and the NRC Our understanding of the MOU, as indicated in Section Ill, is that it applies only to the use of commercial light water reactors (CLWRs) and not to any ancillary facilities such as the l tritium extraction facility. The section reads: i "The purpose of this agreement is to establish the basis for review and consultation by l NRC with respect to DOE's possible acquisition of CLWRs, or acquisition of irradiation services from CLWRs, for the production of tritium."

Consequently, we do not believe that the MOU covers NRC-DOE consultation regarding 'he Tritium Extraction Facility. If you have any questions, please contact Elizabeth Q. Ten Eyck, ,

This is in response to your letter to Carl Paperiello of August 27,1999, in which you asked the Nuclear Regulatory Commission (NRC) staff to review the Preliminary Safety Analysis Report 1 (PSAR) for the Commercial Light Water Reactor - Tritium Extraction Facility. Unfortunately, NRC lacks the staff resobrces to conduct a review of your PSAR and your comparison of regulatory requirements and we will not be able to support this request.

Incidentally, your letter indicated that your request is in accordance witi. ..aorandum of Understanding (MOU) dated May 22,1996, between the Department of Energy (DOE) and the  !

Your letter indicated that the request is in accordance with the Memorandum of Understanding (MOU) dated May 22,1996, between the Department of Energy and,th'e NRC.

Our understanding of the MOU, as ind cated in Section Ill. Purpose, is that it applies only to the use of commercial light water reactors (CLWRs) and not to any ancillary facilities such as the tr' tium extraction facility. The secti'on reads:

Therefore, the MOU doe,s not cover the Tritium Extraction Facility. In addition, at this time, NRC lacks the staff resources to conduct a review of your PSAR Accordingly, we must decline  ;

your request.
