2JUDGE HAWKENS: My name's Roy Hawkens, I'm 3 a Licensing Board Chairman in this case, which is 4 entitled Florida Power & Light Company Turkey Point 5Units 3 & 4. Docket number is 50-250-LSR and 50-251-6 LSR -- SLR.

7 I'm joined by Dr. Sue Abreu and by the 8Board's Law Clerk, Sara Ladin. The third Board 9 member, Dr. Mike Kennedy, had an arising issue at home 10 which prevents him from joining us, but he's 11 authorized Dr. Abreu and me to go forward with this 12 teleconference.

13 Would the counsel for the parties please 14 introduce themselves for the record.

15MR. BESETTE: Your honor, this is Paul 16 Besette on behalf of Florida Power & Light, and I have 17 with me Steve Hamrick.

4 Turk.5MR. AYRES: Your honor, this is Richard 6 Ayres, I represent Friends of the Earth.

7MS. CURRAN: Good morning, Judge Hawkens, 8 this is Diane Curran for Southern Alliance for Clean 9 Energy.10 JUDGE HAWKENS: Thank you, Ms. Curran.

11MR. FETTUS: And good morning, your honor, 12 this is Geoffrey Fettus and I'm representing the 13 Natural Resources Defense Council.

14JUDGE HAWKENS: Thank you, Mr. Fettus.

15 And Mr. Gomez, are you on the line also?

16MR. GOMEZ: Good morning, Judge, yes, this 17 is Albert Gomez.

18JUDGE HAWKENS: All right, thank you. To 19 assist the Court Reporter, when a counsel or 20 representative wishes to speak, please introduce 21yourself prior to speaking. The Board has determined 22 that it will be conducting an oral argument in this 23 case, and the purpose of this teleconference is to 24 establish the venue and the date for the argument.

GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.(202) 234-4433WASHINGTON, D.C. 20005-3701(202) 234-4433 7 Prior to this teleconference, Ms. Ladin 1 polled you regarding where you would prefer the 2 argument to be held and your availability during three 3 different time periods, the week of November 5, the 4 week of November 26, and the week of December 3.

5 Regarding location, the majority of you 6 stated that you preferred or were willing to hold 7argument near the Turkey Point facility. And the 8 Board therefore plans to hold the argument in the city 9of Homestead at their council chambers, which is 10 located at 100 Civic Court in Homestead, FL.

11 Regarding the date of the oral argument, 12 during the timeframes that Ms. Ladin asked about your 13availability, which was the week of November 5, 14 November 26, and December 3, there was not a time when 15all the parties would be available. Because the 16 Board's not willing to delay oral argument beyond the 17 week of December 3, we will set argument for Tuesday, 18 December 4.

19Now, the only entity that will not be 20available for that date is Mr. Gomez. And by 21targeting December 4, Mr. Gomez, that's two months 22 away, and if perhaps it will be possible for you to 23 arrange your schedule in order to attend.

24 If you're not able to attend, the Board 25 NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.W.(202) 234-4433WASHINGTON, D.C. 20005-3701(202) 234-4433 8 wanted to assure you you would not be prejudiced, 1 because the purpose of oral argument is for the Board 2 to ask questions of the parties arising from the 3 written pleadings.

4And if the Board has any questions for 5 you, it can send them to you in writing prior to the 6 argument, and we'll request for you to respond to them 7in writing prior to the argument. But at this point, 8 the Board does not contemplate having any questions 9 for you.10 Next week, the Board will issue a 11 scheduling order that will designate the date, time, 12 and location of the argument, the order in which the 13 parties will make their presentations, and the amount 14 of time allotted to each party.

15 Mr. Gomez, if you look at your schedule 16 and determine that you will be available to 17 participate in the argument, or Ms. Ladin has advised 18 me that you informed her that you may be obtaining 19 counsel, if you find that your counsel is able to 20 participate in argument on December 4, please 21 communicate with Ms. Ladin by either telephone or 22 email before close of business on Monday.

23 In early November, the Board will issue 24 another order that identifies topical areas the Board 25 NEAL R. Also prior to the oral argument, 2 likely in early November as well, perhaps late 3 October, the Board will issue an order that addresses 4 the motion to strike, as well as the alternative to 5 file supplemental pleadings.
