The Commission1 approved a Memorandum and Order responding to Powertech (USA), lnc.'s petition for review requesting that the Commission reverse the Atomic Safety and Licensing Board's denial of summary disposition of Contention 1 A in the Dewey-Burdock materials license amendment matter and terminate the proceeding. The Memorandum and Order denies the petition for review.
(Subsequently, on September 26, 2019, the Secretary signed the Memorandum and Order.)

PDR Section 201 of the Energy Reorganization Act, 42 U.S.C. Section 5841, provides that action of the Commission shall be determined by a "majority vote of the members present." Chairman Svinicki, and Commissioners Baran and Caputo were present in the Conference Room. Commissioner Wright participated in the meeting via speakerphone.
