Dear Mr. Vanderpool:
On October 10, 2018, the U.S. Nuclear Regulatory Commission (NRC), received your request to clarify and confirm certain provisions of the NRCs Export and Import regulations, in particular, the NRC general license for import regulation (10 CFR110.27) for byproduct material.
On August 27, 2010, NRC amended the licensing requirements for imports of certain items that previously required a specific license for import into the United States. This regulatory amendment removed the requirement for persons to apply for and obtain a specific license prior to importing byproduct material contained in sealed sources (excluding radioactive waste),
regardless of the activity of the sources being imported. Such imports are now authorized under a general license (e.g., a paperless authorization to import byproduct material) listed in Title 10 of the Code of Federal Regulations in 10 CFR Part 110.27.
The only other requirements to meet in order to use the general license for import are:
1 The importer must be authorized to possess the material, either under an Agreement State or NRC material possession license; and 2 If the material is listed in Appendix P to 10 CFR Part 110, an advanced notification of import must be submitted at least seven days prior to shipment The NRC has confirmed that the importer located in Illinois is authorized to import, receive and use the Cs-137 source under their Radioactive Material License issued by the state of Illinois license No. IL-01376-01, which is valid until January 31, 2022.
