In accordance with Vermont Yankee Nuclear Power Station (VYNPS) Renewed FacilityOperating License Condition 3.J.a.(iii),
the decommissioning trust agreement must provide thatno disbursements or payments from the trust, other than for ordinary administrative
: expenses, shall be made by the trustee until the trustee has first given thirty (30) days prior written noticeto the NRC.Article IV, Section 4.05 of the Master Decommissioning Trust Agreement by and betweenEntergy Nuclear Vermont Yankee, LLC (ENVY) and The Bank of New York Mellon, successor by operation of law to Mellon Bank, N.A. as Trustee, provides that no disbursements orpayments shall be made by the Trustee, other than Administrative Expenses in accordance withSection 4.02 of the Master Trust Agreement, until the Trustee has first given the NRC thirty (30)days prior written notice of payment;
: provided, however, that no disbursement or payment fromthe Master Trust shall be made if the Trustee receives prior written notice of objection from theNRC Director of the Office of Nuclear Reactor Regulation.
This letter provides the NRC written notification of The Bank of New York Mellon's intent, uponreceipt of a completed Disbursement Certificate from ENVY, to make a disbursement from theVYNPS nuclear decommissioning trust in an amount not to exceed (without a supplemental 30-day notice to the Director)
$8,000,000, for the period of February 2016. The disbursement request is expected to include, among other things, site-specific decommissioning costs relatedto emergency planning contractor costs, insurance and property taxes.11These cost items are identified in the Site Specific Decommissioning Cost Estimate that wassubmitted to the NRC with the VYNPS Post-Shutdown Decommissioning Activities Report (PSDAR)on December 19, 2014. See PSDAR, App. C, Table C at lines la.2.23/1b.2.23, 1a.4.l/1b.4.2 andI a.4.2,1lb.4.3 (ADAMS Accession No. ML1 4357A1 10).
