Dear Mr. Blanton:

This is in response to your 1etter dated January 15, 1987 regarding your Agency's jurisdiction on Indian land.

In the first case~ an Arizona company licensed by the State wishes to relocate onto an Indian reservation. It is the established position of the U.S. Nuclear Regulatory Commission that a private company operating on Indian land in an Agreement State is subject to State jurisdiction.

In the second *case, a well logging company licensed by the State. intends to conduct operations on Indian property.

As in the first case the State retains regulation authority over the private company and its activities including the source lost downhole.
