By {{letter dated|date=December 21, 2001|text=letter dated December 21, 2001}}, Pacific Gas and Electric Company (PG&E) submitted an application to the U.S. Nuclear Regulatory Commission (NRC) for a 10 CFR 72 site-specific license to build and operate an independent spent fuel storage installation (ISFSI) at the Diablo Canyon Power Plant (DCPP) site. Also, by {{letter dated|date=April 15, 2002|text=letter dated April 15, 2002}}, PG&E submitted license amendment request (LAR) 02-03 to allow handling and loading of Holtec International's (Holtec's) multi-purpose canisters (MPCs) and transfer casks in the DCPP 10 CFR 50 facilities. On September 26, 2003, the NRC issued license amendments 162 and 163 to allow implementation of LAR 02-03. Finally, PG&E submitted a request for exemption from 10 CFR 50.68, "Criticality Accident Requirements" for spent fuel cask handling on October 8, 2003.

PG&E's response to this request along with revisions to the proposed 10 CFR 72 Diablo Canyon ISFSI technical specifications (TS) is enclosed with this letter.
As a part of their review of the 10 CFR 50.68 exemption request, the staff, during an October 30, 2003, telephone call with PG&E personnel, requested additional information regarding potential boron dilution events with a loaded MPC located in the DCPP spent fuel pool (SFP).
