APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Docket:
50-458 River Bend Station License:
NPF-47 During an NRC inspection conducted on June 14-18, 1993, a violation of NRC requirements was identified. The violation involved a failure to comply with Technical Specification requirements for approved methods in determining core operating limits.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:
Technical Specification 6.9.3.1 requires that core operating limits shall be established prior to startup from each reload cycle for the minimum critical power ratio and such shall be documented in the core operating limits report.
Technical Specification 6.9.3.2 states that the analytical methods used to determine the core operating limits shall be those previously reviewod and approved by the NRC, specifically those in NEDE-24011-P-A,
" General Electric Standard Application for Reactor Fuel," (latest approved version).
Contrary to the above, the minimum critical power ratio value of 1.18 documented in the core operating limits report for Reload 4, Cycle 5, dated August 28, 1992, was determined using analytical methods other than those documented in the latest version of NEDE-24011-P-A as reviewed and approved by the NRC.
This is a Severity Level IV violation (Supplement I)
Pursuant to the provisions of 10 CFR 2.201, Gulf States Utilities is hereby required to submit a written statement or explanation to the Regional Administrator, Gegion IV, with a copy to the U.S. Nuclear Regulatory Commission, ATIN: Document Control Desk, Washington, D.C. 20555, within 30 days of thre date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that have been taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, the Commission may issue an Order or Demand for Information as to why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
