F Division of Waste Management U.S. Nuclear Regulatory Commission Mail Stop.423-SS Washingt DC 20055 Dear Mr g 1

This letter is a follow up to the phone call you received f rom my of fice last week concerning the EPA Negotiated Rulemaking Project and the low level waste rule.

During the last f ew weeks, ERM-McGlennon Associates has met with the key parties who would most likely be involved in negotiations concerning the establishment of a low level waste standard.

'1hese meetings were intended to identify the specific interests and concerns of the various parties, and most importantly, to determine whether or not they would be willing to participate in this project.

These interviews have revealed that several of the key parties have decided that they are not prepared to participate in negotiations on this particular rule.

As you may recall, one of the original criteria fot rule selection was the willingness of parties to participate in the negotiations.

Because this criterion can not be met, EPA has decided to negotiate an alternative rule.

At the same time, it will proceed to establish the low level waste standard using the traditional rulemaking process.

i I appreciate your support of EPA's Negotiated Rulemaking Project, and the time and energy you spent on the low level waste rule. If you have any suggestions on alternative rules, please contact me.

Sincerely, Jop b cGlennon C7nvenor/Facilitator h /h l O ( O'
