Dear Ms. Murphy:
This is in final response to your letter dated April 10, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), records relating to Information Notice 86-05 and four other categories of records relating to main steam safety valves.
The records identified on enclosed Appendix G are the remaining records responsive to your request. The entire record identified at number two and paragraph four of the record identified at number one are being withheld pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The remaining portions of the record identified at number one do not fall within the scope of your request.
Information withheld pursuant to Exemption (5) in paragraph four of the record identified at number one consists of the preliminary advice, opinions, and recommendations of a member of the staff. Information withheld pursuant to Exemption (5) in the record identified at number two is a draft document which contains the predecisional analyses, opinions, and recommenda-tions of the former Executive Director for Operations to Comissioner Asselstine responding to questions concerning a staff paper, SECY-85-62. The documents do not contain any reasonably segregable factual portions and are being withheld in their entirety.
Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of paragraph four of the record identified at number one are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation. The person responsible for the denial of the document identified at number two is Mr. John C. Hoyle, Assistant Secretary.
