i The Commission, by a 5-0 vote, approved revisions to NRC's emergency planning rule, establishing procedures for evaluating the adequacy of emergency planning at the operating license review stage in situations in which state and. local government officials decline to participate in emergency planning. The revisions provide for adopting the proposed rule as published for public comment on March, 1987, with modifications and clarifications consistent with Commission testimony, responses to Congress on the intended scope and effect of the rule, and                                                       {

The rule recognizes that though-state and local participation in emergency planning is' highly desirable, and indeed is essential for maximum effectiveness of emergency planning and preparedness, Congress did not' intend that the absence of such participation should preclude' licensing of substantially completed nuclear power plants where there is a utility-prepared emergency plan that provide reasonable assurance of adequate protection to the public.
