,j NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 3068H001 June 18,1998 Mr. Brian A. McIntyre, Manager Advanced Plant Safety & Licensing Westinghouse Electric Corporation Energy Systems Business Unit P.O. Box 355 Pittsburgh, PA 15230

SUBJECT:

REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR WESTINGHOUSE AP600 DESIGN LETTER OF FEBRUARY 24,1993, APRIL 19,1993, AND JULY 14,1993

Dear Mr. McIntyre:

Enclosed with this letter is a table of Westinghouse letters you submitted which contain proprietary material that was presented to the Nuclear Regulatory Commission (NRC) staff during meetings.

In these letters, you identify information which you consider proprietary and request that it be withheld from public disclosure pursuant to 10 CFR 2.790. The subject material is provided via enclosure to each letter in both a proprietary and nonproprietary form. Each letter is supported by an affidavit which claims, in part, that the information is classified as proprietary because "The development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a l

considerable sum of money." In addition, the affidavits also state that this information should be l

considered exempt from mandatory public disclosure for the following reasons (as specifically

{

noted on the enclosed table):

{

a.

The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.

b.

It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.

c.

Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, I

or licensing a similar product.

We have reviewed your submittal and the materialin accordance with the requirements of 10 CFR 2.790 and, on the basis of Westinghouse's statements, have determined that the submitted information sought to be withheld does not contain trade secrets or proprietary commercial information. Specifically, the materialis similar to the material that exists in the current non-proprietary version of the probabilistic risk assessment and standard safety l
