NRC ROUTINE RADIATION PROTECTION INSPECTION REPORT

50-440/98012(DRS) AND NOTICE OF VIOLATION

Dear Mr. Myers:

On June 5,1998, the NRC completed an inspection at your Perry Nuclear Power Plant.

The enclosed report presents the results of this inspection.

The inspection was an examination of activities conducted under your license as they relate to

i

radiation safety and to compliance with the Commission's rules and regulations and with the

conditions of your license. Within these areas, the inspection consisted of selective

examinations of procedures and representative records, interviews with personnel, and

observation of activities in progress. Specifically, the inspection focussed on the control of

liquid and gaseous radioactive effluents and the testing of engineered safety feature ventilation

systerns. In addition, the inspection reviewed an incident concerning an individual who entered

the radiologically restricted area without the required dosimetry.

Your staff effectively controlled and monitored liquid and gaseous radioactive effluent releases

from your facility. We observed progress in the reduction of radioactive effluents released and

of radioactive waste produced. Process and effluent radiation monitors were properly

calibrated; however, your staff continued to be challenged by operability problems conceming

'

the liquid discharge radiation monitor. Although we recognize that your goal is to limit the

number of liquid radioactive discharges from your facility, we understand that this monitor was

inoperable for significant periods of time in 1996 and 1997, which unnecessarily challenges

. your sta and reduces the barriers to an inadvertent release of radioactive material to the

environment.

Further, two violations of regulatory requirements were identified during this inspection. These

violations concerned the inadequate posting of a radiation area within your facility and the

'

failure of an individual to adhere to the dosimetry requirements of a radiation work permit.

Although your staff identified and corrected the latter violation, we are concerned that the

individual performed 13 entries into the radiologically restricted area without the required

I

dosimetry, including an entry into a high radiation area. Prior to each entry, the individual was

l

briefed by your radiation protection staff, who missed these opportunities to identify and to

correct the violation. We believe that wearing the correct dosimetry is a fundamental

requirement that should have been identified during these briefings. Consequently, we have

not exercised enforcement discretion and have cited this violation.

The violations are cited in the enclosed Notice of Violation (Notice), and the circumstances

surrounding them are described in detail in the enclosed report. Please note that you are

required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine

whether further enforcement action is necessary to ensure compliance with regulatory

requirements.

In accordance with 10 CFR 2.790 of the Commissions regulations, a copy of this letter, its

enclosures, and your response to this letter will be placed in the NRC Public Document Room.
