Items of Interest Week Ending November 19, 2021 NRC Approves Exelon Fleet License Transfer Application On November 16, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff issued an order (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21277A245) approving the transfer of the Exelon fleet license transfer application. The proposed transaction would separate Exelon Generation Company, LLC (EGC) and its subsidiaries from its parent company, Exelon Corporation. The new competitive energy business would be comprised of HoldCo (the new ultimate parent company), EGC (renamed as SpinCo), and EGCs subsidiaries. HoldCo and SpinCo are placeholders used in the application.
The final names will be determined prior to the completion of the transaction. The NRC order is effective immediately and allows the applicants up to 1-year to complete the license transfer.
NRC Acknowledges NIST Restart Request and Requests Additional Information On November 18, 2021, the staff issued a letter (ADAMS Accession No. ML21294A277) acknowledging the receipt of the National Institute of Standards and Technology (NIST) restart request related to the event on February 3, 2021. The restart request included NISTs root cause investigation and proposed corrective actions. The staffs acknowledgement letter requested additional information, which is necessary to inform the staffs independent assessment of whether to authorize restart of the reactor. The authorization decision will be informed by various factors, including findings of the technical review, inspection activities, and additional information needs identified during the review. The staff has not yet set a schedule for restart authorization.

Items of Interest Week Ending November 19, 2021 Extending the Duration of the AP1000 Design Certification: Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 52 [NRC-2020-0269; RIN 3150-AK56]
On November 17, 2021, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 64063) confirming the effective date of December 6, 2021, for the direct final rule that was published in the Federal Register (86 FR 52593) on September 22, 2021. This direct final rule amends the NRCs regulations to update the design to reflect changes provided by Westinghouse Electric Company LLC and to extend the duration of the AP1000 design certification for an additional five years. The effective date of December 6, 2021, for the direct final rule published on September 22, 2021, is confirmed.
NMSS Terminated the Humboldt Bay 10 CFR Part 50 License On November 18, 2021, NMSS terminated the Humboldt Bay Title 10 of the Code of Federal Regulations Part 50 license (Agencywide Documents Access and Management System Package No. ML21295A249). Humboldt Bay Unit 3 was a boiling water reactor operated by Pacific Gas & Electric (PG&E) from 1963 to 1976. PG&E submitted the last of the final status surveys of the Unit 3 site and requested license termination in October 2021. The NRC staff evaluated the surveys, conducted inspections, and reviewed confirmatory survey analyses before concluding the site met NRC criteria for license termination for unrestricted use.
Humboldt Bay is the 11th power reactor to have its license terminated. The Independent Spent Fuel Storage Installation remains on site under a specific license.
NMSS Staff Participated in a Department of Energy (DOE) Public Meeting to Discuss DOEs Draft Waste Incidental to Reprocessing On November 18, 2021, NMSS staff participated in a DOE public meeting to discuss DOEs Draft Waste Incidental to Reprocessing (WIR) Evaluation regarding the Test Bed Initiative Demonstration for potential disposal offsite at EnergySolutions or Waste Control Specialists radioactive waste disposal facilities. NMSS staff provided a presentation to highlight NRCs role in the review of DOEs Draft WIR Evaluation regarding the Test Bed Initiative Demonstration.
The virtual public meeting was attended by roughly 70 members of the public, industry, and State and Federal governments.
