Items of Interest Week Ending APRIL 2, 2021 NRC Hosted Meeting on Westinghouses EnCore Accident Tolerant Fuel On March 30, 2021, the NRC staff held a partially closed meeting with Westinghouse Electric Company to discuss their status for their near-term EnCore accident tolerant fuel chromium-coated cladding (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML21083A239). The topics discussed included an overview of their program, performance testing, ongoing work, and next steps. The NRC staff plans to prepare a non-proprietary meeting summary.
Staff Approved Licensing Request for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of the approved licensing action provided during this reporting period is summarized below. A complete list of licensing actions approved by the NRC in response to the COVID-19 public health emergency is available on the NRC public website at https://www.nrc.gov/about-nrc/covid-19/reactors/licensing-actions.html.

Items of Interest Week Ending APRIL 2, 2021 NRC Participated in a Meeting of the Federal National Environmental Policy Act Contacts On March 25, 2021, NRC environmental review staff participated in a Federal National Environmental Policy Act (NEPA) Contacts call held by the Council on Environment Quality (CEQ). During the call, CEQ staff noted they are currently conducting a review of NEPA-implementing regulations that were issued in July 2020 (85 FR 43304). The NRC staff continues to conduct its NEPA environmental reviews in accordance with its NEPA-implementing regulations at 10 CFR Part 51. The NRC environmental staff continues to maintain awareness of CEQ activities in this area through participation in interagency working groups and through the Federal Permit Improvement Steering Committee. The NRC staff will keep the Commission informed of the results of CEQs review of the 2020 NEPA-implementing regulations.
NRC Conducted Briefing on Consolidated Interim Storage Facility Application On March 29, 2021, the NRC staff briefed members of the Pilgrim Massachusetts Nuclear Decommissioning Citizens Advisory Panel (NDCAP), on the process and status of NRCs licensing review of the Holtec International and Interim Storage Partners Consolidated Interim Storage Facility applications. During the briefing, the NRC staff provided an overview of the NRCs mission, its roles and responsibilities for spent fuel storage and transportation and the status of the review. The NRC staff answered several questions from the NDCAP members including questions about the potential for expansion of the facilities, questions on the aging management program, and the status of the Yucca Mountain application.

On March 29, 2021, the NRC published a notice in the Federal Register (86 FR 16291) amending its spent fuel storage regulations by revising the Holtec international HI-STORM 100 Cask System listing within the List of approved spent fuel storage casks to include Amendment No. 15 to Certificate of Compliance No. 1014. Amendment No. 15 amends the certificate of compliance to add a new overpack and a new transfer cask, revise allowed content for storage, and make other changes to the storage system. The companion proposed rule was also published in the Federal Register on March 29, 2021 (86 FR 16310). This direct final rule is effective June 14, 2021.
NRC Met with the Department of Energys Office of Environmental Management On March 30, 2021, the NRC staff met with the Department of Energys (DOEs) Office of Environmental Management to discuss waste management activities of mutual interest to both agencies. These activities included the status of various projects related to waste incidental to reprocessing, decommissioning, greater-than-class C waste disposal and status of DOEs interpretation of the high-level waste definition. These meetings are held routinely to ensure a common understanding of activities of mutual interest between the two agencies.

Measurement Standards Used at U.S. Nuclear Power Plants: Petition for Rulemaking; Denial; 10 CFR Part 50 (PRM-50-118; NRC-2019-0071)
On March 31, 2021, the NRC published a notice in the Federal Register (86 FR 16678) denying a petition for rulemaking submitted by Michael Taylor (the petitioner). The petition was docketed by the NRC on March 4, 2019, and was assigned Docket No. PRM-50-118. The petitioner requested that the NRC amend its regulations regarding the measurement standards used at U.S. nuclear power plants. The NRC is denying the petition because the NRCs current regulations and oversight activities provide reasonable assurance of adequate protection of public health and safety. The docket for PRM-50-118 was closed on March 31, 2021.
Unified Agenda of Federal Regulatory and Deregulatory Actions; Semiannual Regulatory Agenda; 10 CFR Chapter I (NRC-2020-0197)
On March 31, 2021, the NRC published a notice in the Federal Register (86 FR 17036) providing the NRCs semiannual regulatory agenda (the Agenda) in accordance with Public Law 96-354, The Regulatory Flexibility Act, and Executive Order 12866, Regulatory Planning and Review. The Agenda is a compilation of all rulemaking activities on which we have recently completed action or have proposed or are considering action. Comments on the Agenda are requested by April 30, 2021.

Office of Nuclear Security and Incident Response Items of Interest Week Ending APRIL 2, 2021 NRC Presented on Emergency Preparedness at Center for Homeland Defense and Security On March 30, 2021, an NRC staff member gave a presentation at a session of the Center for Homeland Defense and Security (CHDS) Radiological Emergency Preparedness Executive Education Program. The presentation focused on the graded approach to emergency preparedness and its application to the Small Modular Reactor / Other New Technologies proposed rule. In attendance at the CHDS session were representatives from State and local emergency response organizations, industry, NEI, FEMA and other federal agencies, and public organizations that support emergency response. The participants gained a better understanding of the correlation between risk and a graded approach to emergency preparedness and a scalable emergency planning zone.
