Unit Nos.1. 2. and 3 Revised Reauest to Use an Alternative to ASME Code Section XI and to Withdraw Previousiv Submitted Reauests for Relief The purpose of this letter is to revise a request previously submitted by Northeast Nuclear Energy Company (NNECO) in our letter of December 15,19950) and modified by a letter dated June 12,1996.(2) These submissions requested relief from portions of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code, Section XI and requested permission to utilize an alternative to the ASME Boiler                                  j and Pressure Vessel Code, Section XI for the Haddam Neck Plant and Millstone Unit Nos.1,2, and 3. Specifically, NNECO is withdrawing its requests for relief as follows:
Millstone Unit No.1, R&R No.1, R&R No. 2, Millstone Unit No. 2, RR-13, RR-14, and Millstone Unit No. 3, IR-23, IR-24. Additionally, NNECO is withdrawing its request to use Code Case N-389-1, " Alternative Rules for Repairs, Replacements, or Modifications Section XI Division 1," for Millstone Unit Nos.1 and 2. The Connecticut Yankee Atomic Power Company's (CYAPCO) requests for the Haddam Neck Plant were previously withdrawn by CYAPCO in a letter dated February 18,1997.9) The

  . B17409\ Page 2 remainder of its current 10 Year Inspection Interval. Therefore, our previously submittedre'que'st for permission to utilize Code Case N-389-1 for Millstone Unit No. 3 remains.
This modification to our previous requests is based on changes to the Code which have occurred since our original submittal and which are not consistent with the positions previously submitted. NNECO currently considers compliance with the Code in these areas to be appropriate based on our current Code applicability.
Code Case N-389-1 has been incorporated into Section XI in the 1988 Addenda which is approved for use in accordance with 10CFR50.55a and thus represents the basis to determine that the requirements in this Code Case provide an acceptable level of quality and safety.
